APPLICANTS' RESPONSE TO TONN OF AMESBURY'S OBJECTION TO AND MOTION FOR RECONSIDERATION OF THE BOARD'S MEMORANDUM AND ORDER OF DECEMBER 4.

1986 Under date of December 15, 1986, tne Tcwn of Amesbury (TOA) has filed a Motion for Reconsideration of the Board's Scheduling Order entered on December 4, 1986.

TOR's first complaint is abtut tne re'quirement that the schedule requires papers served to be in the other parties' hands on the uue date..

There is nothir.g unusual in Commission practice in scheduling matters and requiring service "in hand" by the due date.

This aspect of the motion should therefore be denied.

To the extent that TCA will nave difficulty meeting the filing deadline impcsed with respect to replies to the Applicants' and Staf f 's positions on the cententions pro +fered, Applicants' would have r.o cbjection to the Board

. granting some relief en this matter in light of the holidays.

There is no right to a prehearing cor.ference; cnly an cpportunity to be heard neec be provided.

See Notst99 Liohting & Power.Co. (Allens Creek Nuclear Generating Station), ALAB-565, 10 N;C 521, 525 (1979).

The balance of the motion ccmplains of various deadlines generally as being too tight.

Notning new is presented in support of this generalized complaint.

CONCLi)SION The motion should be deried.

Respectfully submitted, W
