ENCLOSURE 1 NOTICE OF VIOLATION Georgia Power Company Docket Nos. 50-424 and 50-425 .

Vogtle License Nos. CPPR-108 and CPPR-109 During the Nuclear Regulatory Commission (NRC) inspection conducted on September 2-5, 1986, violations of NRC requirements were identified. The violations involved failure to establish adequate measures to protect installed materials and equipment from temporary construction loads and failure to assure applicable requirements are included in procurement documents. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part 2, Appendix C (1986), the violations are listed below:

A. 10 CFR 50, Appendix B, Criterion XIII, as implemented by Section 17.1.13 of the FSAR requires measures be established to control storage of materials and equipment to prevent damage or deterioration.

Contrary to the above, adequate measures had not been established to control storage of installed materials and equipment to prevent damage from temporary construction loads as evidenced by the following:

- Numerous examples of scaffolding supported by Heating Ventilating and Air Conditioning (HVAC) supports, pipe supports, installed piping, and installed HVAC duct were noted.

- The licensee has no documented guidelines to assure that temporary construction loads do not exceed the maximum allowable design loads for piping, pipe supports, HVAC duct and HVAC duct supports.

- Several examples of craft personnel using HVAC duct skin as scaffolding were noted.

This is a Severity Level V violation (Supplement II).

B. 10 CFR 50, Appendix B, Criterion IV as implemented by Section 17.1.4 of the FSAR requires measures be established to assure that applicable regulatory requirements and design bases, which are necessary to assure quality, are suitably included in procurement documents. ANSI /ASME N509-1976, Regulatory Guide 1.52, Revision 2, and Bechtel Specificatice X4J07 Revision 10 have been identified as the applicable documents for the procurement of charcoal intended for safety-related air filter Unit No.1-1531-N7-002. Regulatory Guide 1.52, Paragraph C31, and ANSI /ASME N509, Paragraph 5.2.5 require that a report containing the data for qualification testing and batch testing for charcoal, be provided to the purchaser.

The data for qualification and batch testing for the charcoal intended for HVAC filter Unit No.1-1531-N7-002 was not submitted by the supplier, and was not identified as missing by the licensee, during both receiving inspection and document review, because specification X4J07 did not specify those records as being required.

This is a Severity Level V violation (Supplement II).

Pursuant to the provisions of 10 CFR 2.201, Georgia Power Company is hereby required to submit to this Office within 30 days of the date of the letter transmitting this Notice a written statement or explanation in reply including for each violation: (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
