Dear Conoressman Edgar:
I am pleased to respond to your letter of October 7,1986 to mo regarding the concerns raised by one of your constituents, Bob Anthony.
Mr. Anthony expressed several concerns reoarding the Philadelphia Electric Company's Limerick Generatinod Station.
As your staff is aware, we held the letter of October 7,1986 cendina the receipt of the enclosures to the letter from your office.
'tr. Anthony expressed to you that he thought the Limerick Generating Station, Unit 1, which is currently licensed for operation, should be shut down until serious threats, alleged to exist by Mr. Anthony, are dealt with. Mr. Anthony also enclosed a petition to the Comriission on this subject, as well as some comments dated August 30, 1986 on proposed changes in the Conmission's reoula-tions in 10 CFR Part 2, " Rules of Practice for Ocmestic Licensing Proceedinos."
A notice of consideration of chances to sections of 10 CFR Part 2 was published in the Federal Register on July 3, 1986 (51 FR 24365 ).
The notice provided for receipt and consideration of public comments. We have previously received Mr. Anthony's comments dated August 30, 1986 and will consider them in con-nection with the proposed changes to this part of the NRC's regulations.
The NRC, on numerous prior occasions, has considered concerns raised by Mr. Anthony regarding the Limerick Generating Station. Mr. Anthony has been an active par-ticipant in the Commission's operating license proceedings for this facility and has raised issues before the NRC's Atomic Safety and Licensing Board. Certain of those issues were also appealed by Mr. Anthony to the Atomic Safety and I.icensing Appeal Board and to the Commission. At no time has the NRC, through its Licensing and Appeal Boards and the Commission itself, determined that the issuance of the operating license for the Limerick Generating Station was inappropriate.
Following issuance of the operating license for Unit 1. Mr. Anthony has submitted numerous petitions, includino those ne references in his letter to you, which were dated February 27, 1986, March 5, 1986, August 21, 1986, and September 11, 1986. The petition of February 27, 1986 concerned a variety of matters related to the operation of Unit 1.
Upon completion of its evaluation, the staff deter-mined that Mr. Anthony's petition did not provide a basis for his alleoations.
The documents and proceedings concerning Limerick licensing activities referenced in that petition were known to the staff and did not provide a basis for any further action. Accordingly, the NRC staff declined to take the action sought by Mr. Anthony.

The Honorable Robert W. Edgar Mr. Anthony's petition of March 5,1986 concerned the usage of water from the Schuylkill River to cool the plant. The NRC staff concluded, after an extensive evaluation of Mr. Anthony's claims, that the petition provided no facts or specific information which showed that the licensee had failed to meet the obligations imposed by its operating license and, therefore, denied the relief sought by the petition.
Mr. Anthony's petition of August 21, 1986 also raised concerns regarding the operation of Unit I based on correspondence between the NRC staff and the licensee. Since this petition shed no new light on the issues involved, the staff declined to take the actions requested by Mr. Anthony.
Mr. Anthony's petition of September 11, 1986 basically reviews the experiences with these earlier petitions and expresses disagreement with the NRC's handling of these without providing any further basis related to the health and safety of the public or the protection of the environment to support the petitions.
Accordingly, the Commission declined to take the action requested by this petition.
When petitions submitted by Mr. Anthony raised substantive issues, these issues were carefully evaluated by the staff.
In those instances where the petitions failed to point to substantive new information, the relief requested was denied on that basis.
In these latter cases, the NRC staff also carefully evaluated each of Mr. Anthony's requests but found that the petitions basically reflected disagreement with the NRC over the resolution of issues and were not otherwise e.upported by inforrn tion which would justify the actions sought by the petitions.
In sumary, I believe that Mr. Anthony's concerns have been carefully considered and have been given a thorough response consistent with the Comission's regulations and our objective to ensure adequate protection of the public's health and safety and the environment.
I trust that this information will be useful to you in your response to Mr. Anthony's concerns.
