Dear Sir or Madam:
m y
This is a request under the Freedom of Information Act (5
=
U.S.C. Section 552.)
i I
write to request copies of all
" accident" or
" safety" g
reports made to the Nuclear Regulatory Commisssion by the Univer-
=
sity of California, or any other interested party, which relate to the research nuclear reactor located in Etcheverry Hall. Universi-g ty of California.
Berkeley.
Your response to my request should include all reports which have been submitted as a E
result o.f NRC policies requiring the reporting of accidents, i
exceptions to NRC policies, procedural errors at the referenced reactor and related incidents.
I If the requested records are not in the possession of your agency, I ask that you forward this request to any agency that you believe may have records that are responsive to this request.
In the alternative.
I ask that you inform me of other agencies that g
might have such records.
As you know, the Freedom of Information Act provides that I
even if some requested material is properly exempt from mandatory 5
disclosure, all segragable portions must be released
[5 U.S.C i
Section 552(b)].
If all material covered by this request is
- withheld, please inform me of the specific exemptions that are N
being claimed.
E If the requested material is released with deletions, I
ask I
that each deletion be marked to indicate the exemption (s) being E
claimed to authorize each particular withholding.
5 In addition, I ask that your agency exercise its discretion
=
to release information that may be technically exempt but where E
withholding would serve no public interest.
[
As you know, the Freedom of Information Act provides that E
agencies may reduce or waive fees if it would be "in the public E
interest because furnishing the information can be considered as l
primarily benefitting the public."
[5 U.S.C.
Section 552(a)(4)(A)].
I believe release of this insterial would be of g
benefit to the public because it is pertinent to the decisions p
which individuals must make regarding their choice of a place to
?
live and any ha:ards which are inherent in that place.
I y
therefore ask that you waive any fees relating to this request.
If you have any questions regarding this
- request, please
=
telephone me at the above number.
I would be happy to discuss e
