l DRAFT VALUE/ IMPACT STATEMENT

1. PROPOSED ACTION 1.1 Description The proposed action is to issue Revision 1 to Regulatory ide 3.50 for comment. The title of Regulatory Guide 3.50 would be changed to " Guidance on Preparing a License Application to Store Spent Fuel and High-Level Radioactive Waste." On May 27, 1986, the Commission published a proposed rule (51 FR 19106) that would revise 10 CFR Part 72. One reason for issuing the proposed rule was to provide a regulatory framework for licensing the storage of spent fuel and high-level radioactive waste (HLW) in a monitored retrievable storage (MRS) facility as provided for in the Nuclear Waste Policy Act (NWPA) of 1982. This proposed action would require that Regulatory Guide 3.50 be updated to incorpo-rate guidance to the Department of Energy (DOE) for an MRS license application.

1.2 Need for Proposed Action The need for additional capacity for spent fuel storage is growing. There are indications that applications for storage of spent fuel independent of reac-tor storage pools will become more frequent. Regulatory Guide 3.50 should be updated since it was issued in January 1982. The NWPA requires that an MRS, if approved by Congress, be subject to licensing by NRC. This proposed action would update Regulatory Guide 3.50 and incorporate guidance to 00E on the sub-mittal of a license application for an MRS.

1.3 Value/ Impact 1.3.1 NRC Revision 1 to Regulatory Guide 3.50 would set forth the information needed by the staff for review and approval of a license application to store spent fuel at an ISFSI or spent fuel and HLW at an MRS. This would ensure more com- l plete and efficient review and would be helpful to the staff in their contacts with applicants.

) 1.3.2 Other Government Agencies The guidance is applicable to DOE or any other government agency submit-ting an application for storage of spent fuel and HLW. The value/ impact for l

government agencies would be similar to that for industry (see Section 1.3.3).

1.3.3 Industry i This guidance is useful to industry in that it facilitates the preparation l

of the license application. It ensures the submittal of more complete informa-tion, which will expedite review and approval of the license application.

1.3.4 Public Development and submittal of a license application is not directly related to public health and safety. However, publication of this proposed revision to the regulatory guide would allow for public participation in the active guide.

2. TECHNICAL APPROACH The guide is nontechnical in nature.
3. PROCEDURAL APPROACH The proposed action is the issuance of proposed Revision 1 to Regulatory Guide 3.50. No other procedure is considered appropriate.
4. STATUTORY CONSIDERATIONS 4.1 NRC Authority Authority for this proposed action is derived from the Atomic Energy Act of 1954, as amended, the Energy Reorganization Act of 1974, as amended, the Nuclear Waste Policy Act of 1982, and is implemented through the Commission's regulations in Title 10 of the Code of Federal Regulations, as cited in the introduction to the guide.

4.2 Need for NEPA Assessment Issuance or amendment of guides for the implementation of regulations in r Title 10, Chapter I, of the Code of Federal Regulations is a categorical exclu-sion under paragraph 51.22(c)(16) of 10 CFR Part 51. Thus, an environmental impact statement or assessment is not required for this action.

5. RELATIONSHIP TO OTHER EXISTING OR PROPOSED REGULATIONS OR POLICIES The active guide would be issued under regulations in 10 CFR Part 72. On May 27, 1986, the Commission published proposed revisions to Part 72 (51 FR 19106). An active guide resulting from this proposed action would reflect requirements when this proposed rule is made effective. However, the nature of the proposed guidance is such that significant changes are not anti-cipated when the proposed rule is made effective.

SUMMARY

AND CONCLUSION A proposed revision to the regulatory guide to provide guidance for the format and content of license applications for the storage of spent fuel and high-level radioactive waste should be prepared.
