IMPOSITION OF CIVIL PENALTY - $200,000 By EN 86-37 dated June 4,1986 the Comission was notified of the intent of IE to issue a Notice of Violation and Proposed -Imposition of Civil Penalties in the amount of Two Hundred Thousand Dollars ($200,000) to Philadelphia Electric Company. This action was based on errors by several licensed personnel in the withdrawal of a wrong control rod from the core, the inadequate verification of adherence to the rod withdrawal program, the improper bypassing of the Rod Sequence Control Systems for a control rod, and the inadequate verification of the rod position before bypassing the Rod-Sequence Control System during a reactor startup on March 18, 1986.
The licensee responded to the Notice in a letter dated July 13, 1986. After careful consideration of the licensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalties. Accordingly, an Order Imposing Civil Penalties in the amo' int of $200,000 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
