SGptember 30, 1986 EN 86-74 0FFICE OF INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: University of Utah, Salt Lake City, Utah Docket Nos.50-072 and 50-407 License Nos. R-25 and R-126

PROPOSED IMPOSITION OF CIVIL PENALTIES - $3,000 This is to inform the Comission that a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of Three Thousand dollars ($3,000) will be issued on or about October 6,1986 to the University of Utah. This action is based on transportation, health physics, safeguards, and operation violations. The transportation violations result from radioactive material in the form of a TRIGA reactor core component being transported from the University of Utah campus to a location in Salt Lake City for maintenance and back to the university without shipping papers, proper labeling, or radiological surveys to determine external radiation or contamination limits. The health physics violations involve the failure to perform adequate surveys and the failure to maintain control of the TRIGA reactor core component. Three safe-guards violations involving the Physical Security Plan and four violations involving the operation of the TRIGA reactor were also identified. Collectively, these violations demonstrate the need for improved control of licensed activities to ensure adherence to NRC requirements and safe performance of licensed activities.

It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:

Mailing of Notice October 6, 1986 Telephone Notification of Licensee October 6, 1986 A news release has been prepared and will be issued after the licensee receives the Notice. The State of Utah will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalties may be remitted, mitigated, or imposed by Order.
