2. Task 9 (1) under Subsection C.l.2 entitled Scope of Work as specified in Attachment A of Modification No. 4 is revised as follows:

Provide written and oral testimony as required at ASLB hearings related to Tasks 1(a) through 8(h) under the contract.

a. The level of effort for this task is increased from 1.75 staff months by 1.60 staff months to 3.35 staff months.
b. ' The additional effort is required as ASLB hearings related to the Comanche Peak Program Plan are to begin in the next few months. As a precursor to hearing commencement, the parties are permitted to submit interrogatories to solicit detailed information on items which will be discussed during the actual hearings. The NRC has recently received a large set of these interrogatories from the intervenor relative to the NRC's evaluation of the program plan. The NRC requires that the contractor address a subset of these questions in which TES staff provided direct support in the recent past. The major area of required assistance is quality control /

quality assurance; however, other areas requiring TES assistance may become apparent as the NRC proceeds with their responses to the specific interrogatories.

o 9 c. TES shall be required to provide detailed written responses to assigned questions on a quick, turn-around basis as required by the NRC Project Officer.

3. Subsection C.1.3 entitled Schedule and Level of Effort is revised to extend the completion date of the contract from November 30, 1986 to December 22, 1986.

> 4. Subsection C.2 entitled Meetings and Travel is revised to add the following line item.

u 11. It is anticipated that the following tripswill be required as part of the increased effort (1.60 staff months) under Task 9 (1):

5. Paragraphs 1 and 3 under Subsection G.1 entitled Consideration, Estimated Cost, Fixed Fee and Obligation are revised as follows:

a 1. It is estimated that the total cost to the Government for full performance ll of this contract will be $1,128,461.41, of which the sum of $1,026,012.74 l represents the estimated reimbursable costs and of which $102,448.67' represents the fixed fee.

6. Subsection G.2 entitled Overhead / General and Administrative Rates is deleted l in its entirety and the following is substituted in lieu thereof: l A. Pending the establishment of final overhead rates which shall be negotiated based on an audit of actual costs, the contractor shall be reimbursed for

. allowable indirect costs hereunder at the provisional rate of 126.9 percent of direct labor for' the period June 10, 1985 through December 22, 1985. For the period December 23, 1985 through December 22, 1986, the contractor shall be reimbursed at a rate not to exceed the ceiling rate of 123.9 percent of direct labor. In no event shall the final audited rate exceed the ceiling rate herein established.

B. Pending the establishment of final general and administrative rates which shall be negotiated based on audit of actual costs, the contractor shall ,

be reimbursed for allowable indirect costs hereunder at the provisional I rate of 10.2 percent of total direct costs for the period June 10, 1985 l through December 22, 1985. For the period December 23, 1985 through December 22, 1986, the contractor shall be reimbursed at a rate not to ,

exceed the ceiling rate of 16.8 percent of total direct costs. I C. Notwithstanding A. and B. of this section, said provisional overhead and G&A rates may be adjusted as appropriate during the term of the contract upon acceptance of such revised rates by the Contracting Officer. However, subject to the final audit, ceiling rates can be adjusted downward, not

, upward, to reflect actual experienced rates.

All other terms and conditions set forth under this contract remain unchanged.

Note: Increase in ceiling from $1,107,836.00 by $20,625.41 to $1,128,461.41 is

/ inclusive of the $15,000.00. authorized by the Contracting Officer in a

{ telecon October 3,1986 between P. Edgeworth, NRC, and D. Landers, TES.
