First paper, Mr. Chairman, is66-268, 5
withdrawal of the proposed rule regarding the consideration of 6
earthquakes in emergency planning.
In this paper the Co' mission is being asked to 7

approve a Federal Register notice which withdraws the 9
Commission's proposed rule amending 10 CFR Part 50, Appendix 10 E, and sets forth the reasons for its decision.
11 All Commissioners have approved the Federal Register 12 notice.
Commissioner Asselstine's separate views are included 13 in the notice.
Commissioner Bernthal has separate views in 14' the notice and they will be modified in accordance with the 15 comments on his vote sheet to be included in the Federal 16 Register notice.

Second item is SECY 86-271.
It's 20 options for the response to the presiding officer's 21 recommendations that formal hearings be convened for Sequoyah 22 Fuels Corporation, UF-6 to UF-4 conversion facility.
23 Here the Commission is being asked to respond to a 24 memorandum dated July 3rd, 1986 from Judge Frye, the presiding 25 officer for the Sequoyah Fuels informal adjudicatory

1 proceeding.
The memorandum suggested that the Commission 2
convert the hearing to a-formal trial type adjudication 3
under the procedures set forth in 10 CFR Part 2, Subpart G.
4 Chairman Zech, Commissioner Roberts, Commissioner 5
Carr have approved the order as modified by Commissioner Carr, 6
in which the Commission declines again to exercise its 7
discretion to apply its procedures governing formal 8
adjudications to this particular license proceeding.
9 Commissioner Bernthal approves in part, and 10 disapproves in part.
Commissioner Asselstine disapproves.
11 They both will have separate views which will be attached to
- 1:2 the order.
