NOTICE OF VIOLATION Abington Memorial Hospital Docket No.

070-01402 Abingt.on, Pennsylvania 19001 License No. SNM-1412 j

As a result of the inspection conducted on March 3, 1987, and in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy) (1986), the following violation was identified:

Condition 13. of License No. SNM-1412 requires that the licensee report to the Commission, within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> of occurrence, the death of any nuclear pacemaker patient.

Contrary to the above, a nuclear pacemaker patient died in July 1985 at Abington Memorial Hospital, was buried with the nuclear pacemaker, and-as of March 3, 1987, the death had not been reported.to the Commission.

This is a Severity Level IV violation (Supplement VI).

Pursuant to the provisions of 10 CFR 2.201, Abington Memorial Hospital is hereby required to submit to this office within thirty days of.the date of-the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken'and the i

results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
