SUBJECT:

POTENTIAL ITEMS FOR NOTIFICATION OF DIABLO CANYON HEARING BOARD

.A set of items has been presented to Region V in the form of allegations  !

from the Mothers for. Peace. The concerns deal with precurement problems, a problem in quality control documentation, management support of the I

quality organizations, potential harassment of quality organization personnel, untimely resolution of nonconformances, and the Quality Hotline organization. Enclosed is the Mothers for Peace submittal, and our characterization of their concerns. Region V has blacked, out and the Mothers for Peace have omitted names to avoid identifying specific individual.

This information is part of an ongoing inspection. Our Allegation Review Board recommended that NRR be notified of these allegations so that

ALLEGATION TRACKING SYSTEM NO. RV-87-A-0003 '

This refers to your telephone calls, and a subsequent meeting with Mr. P. P. Narbut of my staff on January 21, 1987, in which you expressed concerns related to practices in several areas at the Diablo Canyon Nuclear Power Plant.

An enclosure to this letter documents your concerns as I understand them based on my conversation with Mr. Narbut. I have requested that two of the senior staff from Region V and Mr. Narbut look into this matter during an upcoming inspection. Therefore, if the enclosure does not ccmpletely and accurately reflect all of your concerns, please contact Mr. Narbut as soon as j possible at (805) 595-2353 so that we can assure that they are adequately l addressed during the planned inspection.

I. Procurement of Materials and Components - The concerns are that:

A. "Off-the-shelf" components were used in safety-related applications {

without performing acceptable upgrading evaluations. i B. Components were purchased from uncontrolled sources. i l C. Parts were manufactured onsite without controlled manufacturing processes.

D. . Purchase order requirements for some safety-related components were l incorrect for the eventual application of the cocoonents. j l

i II. Quality Control Documentation l A. Quality Control (OC) observation points in work packages have been j lined out or falsely filled in by operators.

III. Pacific Gas and Electric (PGAE) Management does not adequately suoport the Quality Organizations. Alleged examples which demonstrate the 1

l inadequate support are:

A. Funds for the Quality Assurance (OA) investigation of the .

procurement problems were withheld.

B. QA reports too low in the organization. The OA manager should be at the vice president level and report directly to the president.

C. The QA manager is excluded from staff meetings and is not briefed on problem areas by PG&E vice presidents.

D. QC does not report to QA and, therefore, cannot function independently.

E. 0A has not been allowed to take a pro-active stance to address problems as they see them arising.

F. IAseniormemberofmanagement],didnotfollow-uponthepresident's instr'uction to : 1) write an open letter to the QA department to inform them of the status of the investigation into the procurement-relatedharassmentissue;or2)have[seniorplantmanagement) invite OA into [hisl office and express plant management's support of QS and opposition to any harassment.

G. The " unwritten law" in the OC department is " Don't make a wave,"

which it tacitly endorsed by manacement.

., <: to 1Y. QC and 0A Personnel have been harassed and intimidated. Examples

  • demonstrating the alleged. intimidation and harassment are:

A. [A supervisor 1 has harassed OC personnel, including requiring that QC notify fhim] of areas to be examined prior to the audit.

B. The QA manager was told to stop his investigation of the procurement problem by [ 1, and QA was not informed of the resolution of the problem.

C. A[ l would go into " incredible triades" and make a QC l inspector a week wear or hang a rubber chicken, i

D. There were instances where [several members of PG&E management]

implied threats and made derogatory statements about QA or QC.

E. One girl, who testified that she was harassed, was fired.

F. OC reports were required to be rewritten to make them acceptably

" mild" for management.

G. The QA manaaer's investigation report into the pocurement-related harassment issue was called a " hatchet .iob."

H. Work packages are brought to QC by operators for review with short notice prior to commencement of the work.

V. Nonconformances have not been resolved in a timely manner. Examples demonstrating the alleged concern are: j A. The procurement issue has not been fully resolved, and it was identified more than two years ago. i B. [ l knows of nonconformance problems that have not been resolved or dealt with in a timely manner.

C. OC and QA are not notified of serious nonconformance problems or have been denied access to such information.

VI. The Ouality Hotline daes not report to the quality organization and, therefore, can not r.ffectively address concerns, since line organizations hide or subvert cor,cerns.

ROARD NOTIFICATION REGARDING CONCERNS ON DIABLO CANYON (BN 87-03)

In accordance with the NRC procedures for Board Notification (BN) we are providing for your information'the attached letter from Dennis F. Kirsch, Reaion V. to Nancy Culver of the San Luis Obispo Mothers for Peace, dated January 30, 1986. The letter documents concerns reaarding the Diablo Canyor Nuclear Power Plant, made by Mothers for Peace with respect to procurement problems, cuality control documentation, management support of the cuality organizations, potential harassment of quality organization personnel, untimely resolution of non-confonnances, and the Quality Hotline organization.

The concerns do not pertain directly to issues on the Diablo Canyon spent fuel pool expansion which is the sub.iect of a' hearing before the Atomic Safety and Licensing Board, currently scheduled to commence on March 9, 1987. (Mothers for Peace was an'intervenor in these proceedings until January 13,1987.) However, l we believe that the subject matter of the concerns may involve substantial public, '

press or Conaressional interest. For this reason we are providing you with the enclosed information. As stated in the letter Region V staff will be looking into the matter during an up. coming inspection.

We have requested Region V to l keep us informed of any developments and results of their effort. We will

. inform you promptly.
