Applicants answer " Town of Amesbury's Contentions of NHRERP Volume 6, Seabrook Station Evacuation Time Study (Identified as Appendix E in Local Plans)" as follows:

1. All of the contentions are addressed to the new KLD Evacuation Time Estimate (ETE). Applicants have taken t and continue to take the position that the only ETE subject to litigation in an operating license proceeding is that 1

2. Even assuming that the KLD ETE was an appropriate

. subject for litigation, Amesbury's Contention Nos. 2, 3 and 4 are unaccompanied by any proper statement of basis.

No. 7, in whole, and No. 8, in part, are based on the Massachusetts refusal to participate. No litigable issue is raised by these contentions in light of the Commission's
