Dear Mr. Fisher:
This letter is written in response to your letter to us of May 8,
1987 which asked for further information in regards to our
alleged Violation A in your letter to us of March 12, 1987.
(1)
We admit that we did not follow the Technical
Specifications
Section
II,
" Operational
Limitations
and
Restrictions."
Specifically Section
II.C.
2,
5,
6, and 7.
However, we do not admit that this was a violation because our
reactor operator license Condition 2 specifically forbid us from
operating the reactor (see enclosed copy).
(2) The corrective steps that have been taken are as
follows:
a) we have unloaded the fuel and shipped it off site;
b) we have requested an amendment to our Reactor License R-109
requesting " Possession
Only" status.
The above Technical
Specifications will be deleted from our reactor license when the
amendment is granted.
(3) Same as (2).
(4)
The date when full compliance is achieved will be when
the amendment is approved.

Pursuant to the Atomic Energy Act of 1954, as amended, the Energy Reorganization
Act of 1974 (Public Law 93-438), and subject to the conditions and limitations
incorporated herein, the Nuclear Regulatory Comission hereby licenses you to
direct the licensed activities of licensed operators at, and to manipulate all
controls of, the Brigham Young University Nuclear Reactor Facility Facility
License No. R-109.

Your License No. is SOP-873-9. Your Docket No. is 55-2453. The effective date
is May 12, 1985.
This license is subject to the provisions of Section 55.31 of the U.S. Nuclear
Regulatory Commission's regulations, Title 10. Code of Federal Regulations,
-
Chapter 1, Part 55, with the same force and effect as if fully set forth herein.
In directing the licensed activities of licensed operators and in manipulating
the controls of the above facility, you shall observe the operating procedures
and other conditions specified in the facility license which authorizes
operaticn of the facility and shall comply with the following conditions:
1.
You shall wear corrective lenses while performing the activities
for which you are licensed.

2.
This license only allows fuel handling and decommissioning
activities. No reactor operation is allowed until prior
approval is received from NRC, Region IV.
The issuance of this license is based upon examination of your qualifications,
including the representations and information contained in your application

for license filed under the docket number indicated above.
Unless sooner terminated, this license shall expire 2 years from the effective
date.
A copy of this license has been made available to the University.
