Dear Dr. Moghissi:

'Thank you for your.' letter of May 8,1987, requesting information on two NRC rulemaking proceedings:

10 CFR Part 20, Standards for Protection Against Radiation.

10 CFR Part '140, Subpart E, Criteria for Extraordinary Nuclear Occurrences.

The NRC staff is currently working on categorizing and analyzing the more than 800 letters of public comment received on the Part 20 rulemaking. A decision on the continuance and direction of this rulemaking will'be made this summer.

Publication of a final rule is presently scheduled for January 1989.

A redrafted rule revising the criteria for extraordinary nuclear occurrence (EN0) is currently undergoing interoffice review. We anticipate that it will be published this summer.

The public comments eceived on the proposed rules are available in the NRC Public Document Room (PDR). The Part 20 rule is in the PDR Docket: PR-19, 20, 30 et al.

(50 FR 51992); the EN0 public comments are in Docket: PR-140 (50 FR 13978). Although we will consider comments received at any time, the public comment periods for both of these proposed rules closed last year.

Consequently, there is no assurance that any comments or position statements submitted at this late date could be considered, particularly for the Fort 140 EN0 rulemaking which is in a final stage of development.
