i NOTICE OF VIOLATION Illinois Power Company Docket No. 50-461 As a result of the inspection conducted on March 25 through June 1, 1987, and in accordance with 10 CFR Part 2, Appendix C - General Statement of Policy and Procedure for NRC Enforcement Actions (1985), the following violations were identified:

1. Clinton Technical Specification 4.0.5 requires, in part, that inservice testing of pumps and valves be performed in accordance with Section XI of the ASME Code unless specific relief has been granted by the Commission.

Technical Specification 4.0.4 requires, in part, that entry into an Operational Condition shall not be made unless the Surveillance requirements associated with the Limiting Condition for Operation have been performed within the applicable surveillance interval. Technical Specification 3.6.4 requires, in part, that the Containment Monitoring System isolation valves be operable during Operational Conditions 1, 2, and 3. IWV-3300 requires that valves with remote position indicators shall be observed at least once every two years to verify that valve operation is accurately indicated.

Contrary to the above, the remote position indication in the Control Room for Containment Monitoring System isolation valves ICM011, 1CM012, ICM022, 1CM023, 1CM025, 1CM026, 1CM047, and 1CM048 had not been properly verified prior to April 15, 1987, although the unit entered Operational Condition 1.

This is a Severity Level IV violation (Supplement I).

2. Criterion V of 10 CFR Part 50, Appendix B, states, in part, that activities affecting quality shall be prescribed by documented instructions, procedures, or drawings, of a type appropriate to the circumstances. Technical Specification 4.0.5.a requires, in part, that inservice testing be performed in accordance with Section XI of the ASME Code. IWV-341 of Section XI of the ASME Code requires, in part, the valves shall be exercised at least once every three months. These requirements were intended to be met by the performance of Clinton Procedure CPS 1887.00.

Contrary to the above, procedures were inappropriate to the circumstances in that Program Procedure CPS 1887.00 violated Technical Specification 4.0.5 requirements by not specifying quarterly valve stroking for the Process Sampling and Containment Monitoring solenoid containment isolation valves as required by Section XI of the ASME Code; and CPS 9061.03, the associated implementing test procedure, was revised on March 18, 1987, to delete the quarterly stroking of these valves.

This is a Severity Level V violation (Supplement I).

Notice of Violation 2 Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
