By letter dated May 7,1987, we requested your Corporation to remit ~ a
$150 application fee for Attachments 1 and 2 to approved Topical Report No. XN-NF-85-67(P), Revision 1, entitled " Generic Mechanical Design for Exxon Nuclear Jet Pump BWR Reload Fuel." Your letter dated May 12, 1987, stated that a $150 application fee is not applicable because the submittal resulted from "a direct request from the NRC concerning a Topical Report approved by the NRC...."
The July 23, 1986 acceptance letter for Topical Report XN-NF-85-67, Revision 1, completed the review for the subject report. That letter stated that additional justification with regard to fuel rod bowing must be provided for operation with burnup values beyond the 30,000 MWD /MTV for the 8X8 fuel and 23,000 MWD /MTU for the 9X9 fuel. This statement was not a direct request for submittal of certain information but rather a statement to the effect that if your Corporation desires approval for operation beyond the approved burnup values, you must submit additional justification.
Consequently, the Office of Nuclear Reactor Regulation staff view your submittal of the additional justification regarding fuel rod bowing to exposures beyond the already approved burnup values as a new request requiring their review and approval.
Based on the above, your submittal is subject to the fee provisions of-10 CFR 170.21.J. Your Corporation is requested to remit the $150 application fee requested in our letter dated May 7,1987.
