APPLICANTS' MOTION FOR DECISION ON MOTIONS FOR
SUMMARY
DISPOSITION ON FILE AND FOR HEARING SCHEDULE WITH RESPECT TO NEW HAMPSHIRE EMERGENCY PLANNING ISSUES 1.
On January 17, 1986, this Board issued an Order scheduling hearings with respect to contentions arising out of the contents of the New Hampshire Radiological Emergency Response Plan (NHRERP).
Subsequent orders modified this
~
schedule to provide, inter alia, for hearings to commence on 1
August 4, 1986.
2.
On July 11, 1986, on motion of the Federal Emergency Management Agency (FEMA) and others, the Board deferred i
those hearings.
A major reason given by FEMA for seeking deferral of the hearings was the then contemplated major 8609300372 860925 PDR ADOCK 05000443 G

revision of NHRERP (" Revision No. 2") to be submitted to FEMA's Regional Assistance Committee (RAC).
3.
Revision No' 2 of NHRERP has now been' submitted to the RAC and also has been distributed to the Board and the Parties.
4'.
There are still sub judice the Board a number of motions for summary disposition filed with respect to extant contentions arising out of NHRERP.
5.
In addition, it is likely that the issuance of Revision No. 2 may give rise to attempts to allege late-filed contentions with respect to NHRERP.
WHEREFORE, the applicants move the Board as follows:
A.
To issue decisions with respect to the pending i
motion for summary disposition.
B.
To issue an order setting a deadline for the filing of any late-filed contentions based upon the issuance of l
Revision No. 2.of NHRERP.
i C.
To reschedule the adjudicatory hearings on NHRERP contentions.
