APPLICANTS' REPLY TO TOWN OF AMESBURY'S OBJECTION TO THE ORDER OF THE BOARD IMPOSING SANCTIONS (9-11-86)

Under date of September 19, 1986, the Town of Amesbury (TOA) filed a document entitled " Town of'Amesbury's Objection to the Order of the Board Imposing Sanctions (9-11-86)."

For the reasons set forth below the applicants say that the objection should be denied.

The basis for the objection to the sanctions order is the fact that it issued without the Board having ruled upon a motion filed by TOA on July 1, 1986 seeking a protective order with respect to a motion to compel which had already been issued.

motion was a nulli.ty when filed.

Motions for protective order are nat in order after a motion to compel has been souaht and granted; the time f:)r filing such a motion is when the original response to discovery was due.

Therefore there was no requirement that the Board rule on it at all.

To allow this objection, is to grant to a party the right to flout the rules cf practice and to control-the course of the proceeding as it, rather than the Board, sees fit.
