APPLICANTS' ANSWER TO MOTION FOR RECONSIDERATION BY THE TOWN OF RYE OF BOARD ORDER GRANTING APPLICANTS' MOTION FOR SANCTIONS SEPTEMBER 11, 1986 Applicants hereby reply to the Motion for Reconsideration of Board Order Granting Applicants' Motion for Sanctions September 11, 1986 filed by the Town of Rye (Rye) and say that the same should be denied.

The speaking motion consists of a number of shrill observations as to supposed prejudice, alleged deprivation of constituted rights, alleged arbitrariness, etc.

Nowhere does Rye attempt to justify its wholsesale disregard of (1)

Applicants' interrogatories; (2) this Board's Order 8609300168 860923 PDR ADOCK 05000443 Q

,p compelling discovery or (3) Rye's failure even to respond to the motion for sanctions.

This is the stuff of which a proper motion for reconsideration would be fashioned.

No such effort has been made; indeed none could be; given Rye's wholesale disregard of its obligations as a participant in this proceeding.
