Dear Mr. Gad:

Subject:

In the Matter or Texas Utilities Electric Company, e_t,,al.

Application for an Operating License Comanche Peak Steam Electric Station Units 1 and 2 Docket Nos. 50-445 and 50-446 - O

I have just received Applicants' Fif th Progress Report dated liay 18, 1987.

As you will recall, I committed to review the results reports and the attachments before committing to any further scheduling delays of the deposi.tions previously scheduled for the end of April 1987. It was my understanding that you were going to attach to the Fifth Progress Report memoranda and other documents which described what areas of the CPRT were being

" closed down" and which areas of the CPRT were going to be completed and relied upon by further inspection and corrective action programs.

Your commitment to me was that Revision 4 of the CPRT Plan would be filed either with the Progress Report on May 18, 1987 or that we could expect the Fifth Progress Report by tiay 11, 1987. Both dates have passed, and we still have not received Revision 4 of the CPRT. Also, the Fifth Progress Report doas not attach any of the significant memoranda that you , described to me in our last telephone conversation. Please contact me as soon as possible to inform me when further substantive materials will be made available so that CASE may decide on its course of action regarding the CPRT adequacy issues.

Thank you for your prompt attention to this matter.

Since rely ,
