On-Site Issues MOTION TO COMPEL NRC STAFF TO PRODUCE NRC PROJECT MANAGERS FOR SEABROOK AS WITNESSES The Seacoast Anti-Pollution League hereby moves the Board to compel NRC Staff to produce all NRC Project Managers for Seabrook Station since April 15, 1983 as witnesses at the upcoming hearings on on-site issues.

It is essential to the issue of determining compliance with the NUREG - 0737 Supp. No. 1 requirements relative to the SPDS that SAPL be able to examine the NRC Project Managers about the agreements reached by any or all of them and the Applicants relative to the date by which the Applicants were to have completed the SPDS.

Pursuant to NUREG - 0737 Supp. No.

1, the licensees were to submi t a proposed schedule f or comple t ing ac t ions to comply with the requirements.

At page 2, paragraph 1 o f NUREG - 0737, Supp. No.

1, it states:

Each licensee's proposed schedule will then be reviewed by the ass igned NRC Proj ect Manager, who will discuss the subject with the licensee and mutually agree on schedules and completion dates.

The implementation dates will then be formalized into an enforceable document.

SAPL has asked the s taf f to produce the appropria te NRC Proj ect Manager or Managers for cross-examination.

The staff has this date declined to produce voluntarily said witness or witnesses, k

i As this Board noted in its footnote 11 in its Memorandum and Order of September 15, 1986:

Staff does not

argue, and we are unaware, that any scheduling agreement arrived at by the Staf f and Applicant pursuant to Supplement 1

is not properly subject to challenge and to judicial review.

SAPL believes that the implementation schedule for the SPDS is an enforceable mat ter and is therefore of key importance f rom a legal standpoint in any determinations as to whether or not the SPDS meets the basic NRC requirements.
