CASE MOTION FOR DISCOVBRY OF THE STAFF (CPRT)

It is CASS's view that wnen the Board ordered discovery to commence for a limited perloc witn respect to the CPRT it intenaea tnat sucn alscovery, it relevant to tne adequacy of tne CPRT, was proper against tne Statt, particularly witn regard to SS6K-13, the tacts and cases tor tne conclusions contained therein, and any contrary tacts or cases.

Tnus tne Boara nas determined that tne requirements ot 32.720th1(2)(ii) nave Deen met with respect to interrogatories accressing these issues, nowever, out ot - an aoundance of caution and to avoio unnecessary litigation, CAss suomits the following argument in support or tnis request tor interrogatories ana in support of tne request tor cepositions or tne persons named in tne attacned notices of deposition.

Tne questions are uniquely answeraole only by the Staff.

Similarly the depositions seen the sworn testimony or tne Statt persons. who nave the personal knowleoge upon which tne-SSER 13 conclusions are based, wno are tne principal authors or immediate supervisors of those responsiole tor SSEa 14, and/or wno nave personal knowledge of tne facts related to Statt 11ndings wnicn were a principal impetus for the CPRT.

Tne Notices of Deposition fully explain tne unique intormation tnat each aeponent possesses that requires their attendance and testimony.

Since tnis Board must decide wnetner the CPRT is adequate and since the Staf f is a party with claimed expertise on this issue and an opinion based on tnat expertise, it is essential to a proper aecision tnat the Board know, througn this discovery, the facts and oasis for and any facts contrary to tne SSER 13 tindings.

Our reading of 332.744 and 2.790 is tnat a document request is to De answered as if it were a Freedom or Information Act (F01A) request ana tnat even accuments that are FOIA exempt are produceaole following a Statt assertion of exemption and a Board ruling.

FvIA responses are uue in 10 cays.

CASE will accept document procuction from tne Statt on the same scheaule as its answers to interrogatories.

For tne foregoing reasons, CASE contends tnat the attached discovery ot tne Statt is appropriate and snould oe allowed.
