LILCO'S MOTION FOR PROTECTIVE ORDER GOVERNING INTERVENORS' QUESTIONING OF WITNESSES AND REQUEST FOR EXPEDITED BOARD RULING LILCO, by counsel, pursuant to S 2.740(c) of the Rules of Practice of the Nuclear Regulatory Commission, moves this Board to enter a protective order restricting ques-tioning of LILCO's witnesses and deponents by Suffolk County, State of New York, and Town of Southampton ("Intervenors") to matters raised by admitted contentions.
LILCO requests that this Board grant permission for its witnesses to decline to answer irrelevant questions about events other than the actual conduct of the Exercise on February 13,1986. In support of its motion LILCO states the following:
- 1. The issues currently before the Board are whether the events that occurred on the day of the Exercise demonstrate that there is a fundamental flaw in the LILCO Plan and whether the scope of the Exercise is consistent with regulatory requirements.
To resolve those quesfions the doard must determine whether LILCO's performance in the actual Exercise satisfied the Exercise scenario and objectives and whether the Ex-ercise, as tested, was consistent with regulatory requirements. Pre-Exercise events.
1/ The Board may make an order "which justice requires to protect a party or per-son from annoyance, embarrassment, oppression, or undue burden or expense, including one or more of the following: . . . (4) that certain matters not be inquired into, or that the scope of discovery be limited to certain matters." 10 C.F.R. S 2.740(c).

including planning and development of the Exercise scenario and objectives and pre-Exercise training of LERO personnel, and the LERO training program generally are not the subjects of admitted contentions. Consequently, questions about pre-Exercise events, pre-Exercise LERO training or matters generally related to the LERO training program or the Plan should be prohibited as irrelevant and not calculated to lead to the discovery of admissible evidence.W
- 2. Intervenors have taken the position in other pleadings filed with this Board that the contentions take the Exercise scenario, the Exercise itself, and the FEMA evaluation process as they existed on February 13, 1986. They are a given in this pro-t ceeding and are not " challenged." See Suffolk County, State of New York and Town of Southampton Response to " Federal Emerg(ncy Management Agency's Motion to Recon-sider Atomic Safety and Licensing Board Pre-Hearing Conference Order Dated October 3, 1986, and Memorandum and Supporting Affidavit in Support of that Motion" (November 10,1986) at 10. Consequently, questioning witnesses and deponents about pre-Exercise events, pre-Exercise LERO training, and LERO training generally is inap-propriate because Intervenors themselves have acknowledged that the scope of inquiry in this proceeding is limited to the Exercise itself. .
- 3. An Intervenor may not adduce affirmative evidence on an issue not raised by that Intervenor unless and until the Intervenor amends his or her contentions.

encompasses events, occurrences, or activities pre-dating the Exercise, Intervenors should be precluded from questioning witnesses about matters or events which occurred prior to the February 13,1986 Exercise.
- 4. On November 22, 1986, LILCO filed a Motion for a Protective Order in Response to Suffolk County's Motion to Compel with respect to certain of LILCO's responses to the Intervenors' First Set of Interrogatories and Requests for ProdJction of Documents filed October 10, 1986. In that Motion and an attached Opposition, LILCO specifically objected to Intervenors' requests for information relating to the develop-ment of the Exercise objectives and scenario (Interrogatories 15-18) and to Intervenors' request that LILCO produce documents pertaining to pre-Exercise training of LERO personnel (Interrogatories 19,20 and 21). The same arguments made there with respect -
to documents and interrogatories apply with equal force to potential questions at depo-sitions. LILCO's opposition there, and again in this Motion, is based in large part on the irrelevance of such information to the issues before this Board as embodied in the admitted contentions.
- 5. With respect to information sought on training, as LILCO pointed out in its Opposition to Suffolk County's Motion to Compel, the training program itself has been extensively litigated in 31 weeks of hearings during the plan litigation. The details of LERO training methods and materials are well known to Intervenors and the Board.

attempts to resurrect training issues previously considered by this Board. Intervenors should not be permitted, under the guise of Contention EX50, to expand their inquiry into training matters beyond the real issue and the only issue admitted by the Board -

> 6. Intervenors' Interrogatories and Request for Production of Documents directed to discovery of pre-Exercise training documents and their Motion to Compel discovery of that information evidence their intent to inquire into pre-Exercise training in discovery. Similar inquiry can be anticipated to occur at the depositions of LILCO's witnesses.
- 7. Interver. ors have also sought through their Interrogatories and Requests for Documents to go beyond the issue of the Exercise and to inquiry generally into post-Exercise training measures employed by LERO. See e_.L. Suffolk County's First Set of Interrogatories and Request for Production of Documents to Long Island Lighting Company Interrogatories 22,23, and 24. In response, LILCO provided Intervenors with documents that were used in post-Exercise training and a list of the changes to the ge-neric training materials so that Intervenors could focus on the " fixes." As the above referenced quotation from the Board's Prehearing Conference Order clearly indicates, only training issues germane to the FEMA Exercise of February 13,1986 are the legiti-mate substance of Contention EX50. Consequently, LILCO objects to the Intervenors' questioning any witness about post-Exercise training methods and materials if the ques-tioning is not directed to what Contention EX50 alleges were the flaws.in the training program as revealed in the Exercise. The post-Exercise materials are relevant only insofar as they relate to remedial measures prompted by the Exercise evaluation. In-tervenors should be precluded both on relevancy grounds and because the Board has held that.it will not' permit duplicative litiga' tion (Pr'ehearing Conference Order (October 3, 1986) at 9), from questioning witnesses about the general LERO training program or de-velopments in that program. The methods and materials employed in -the LERO training program have already been litigated. LILCO's ongoing efforts to create an even better LERO training program are not at issue.

- 8. Intervenors' questioning of FEMA's deposition witnesses evidences their Intent, despite repeated objection from other counsel, to inquire into matters not rele- 1 vant to the issues in controversy in this proceeding. In particular, during the depost-tions of FEMA's witnesses Intervenors sought discovery of the development of the exer-cise objectives and scenario. The attached exhibits from Suffolk County's deposition of Mr. Edward Tanzman, on November 25,1986 are illustrative of Intervenors' attempts to probe pre-Exercise events related to the development of the Exercise scenario and ob-jectives.EI These matters are clearly irrelevant to this proceeding. Nevertheless, In-tervenors' questioning repeatedly strayed teyond the permissible scope of discovery.S!
LILCO maintains evidence of such impermissible inquiry.in the past estabushes the real threat of inappropriate questioning of LILCO witnesses on similarly irrelevant matters '
in upcoming depositions even in the face of objections b; counsel for LILCO. For ex- l ample, various LILCO witnesses worked with FEMA on the development of the Exercise scenario and objectives. S_ee attached Tanzman Deposition Exhibits. As such, they acted as consultants for FEMA and will require FEMA's authorization to reveal any po-l tentially privileged information pertaining to the development of exercise scenarios and objectives.EI Intervenors should be barred from questioning LILCO's witnesses on
, the development of the exercise objectives and scenario, which are wholly irrelevant 3/ To date, no transcript of Mr. Tanzman's deposition is available; however, the deposition transcript will only amplify what these exhibits merely hint. Intervenors questioned Mr. Tanzman extensively about the meetings, correspondence, conversa-tions -in short, every aspect - of the development of the exercise objectives.
3 3/ In the case of Mr. Tanzman's 8-9 hour deposition, Intervenors' questioned Mr.
Tanzman for almost three hours about his involvement in and recollections about the development of the exercise objectives.
5/ Recently, this Board tacitly recognized the consulting relationship between FEMA and some LILCO employees when it denied Suffolk County's request that FEMA .
be ordered to turn over all documents which FEMA previously shared only with LILCO.

y matters and which concern information under FEMA's control or for which FEMA may claim a privilege.
- 9. The likelihood of questions by Intervenors pertaining to pre-Exercise events, pre-Exercise training and LERO training generally, all of which are not rele-vant to admitted contentions, prompts LILCO to seek a Protective Order. LILCO's wit-nesses solely by virtue of their association with LILCO are particularly knowledgeable about LILCO and LERO matters, many of which are well beyond the appropriate scope of inquiry for this proceeding. Inquiry into these irrelevant matters is beyond the bounds of legitimate discovery, and questioning of LILCO's witnesses about these irrele-vant matters will needlessly prolong the depositions without leading to the discovery of admissible evidence.
- 10. LILCO requests that this Board, through a protective order, clarify the scope of inquiry in this proceeding. Such an order would ensure the orderly and expedi-tious conduct of appropriate discovery by (1) reducing irrelevant questioning by Inter-venors, (2) obviating the need on LILCO's part to object repeatedly to irrelevant ques-tioning by Intervenors, and (3) reducing the likelihood that tnis Board would receive motions to compel from Intervenors and motions for protectile orders by LILCO at later, more time-constrained points in this proceeding. Because of the discovery sched-ule in this proceeding, it is particularly important thpt delays ;esulting from motion practice be avoided. A prior protective order would go a long'way toward eliminating motions to compel and for protective orders generated as a consequence of irrelevant and burdensome discovery. For these reasons LILCO does not believe a protective order governing Intervenors' questioning of witnesses and deponents is premature at this time.
- 11. Accordingly, good cause having been shown, LILCO requests that the Board issue a protective order permitting LILCO and its witnesses to decline to answer the 1 l
following categories of Intervenors' questions:

(1) questions that address pre-Exercise events related to the development of scenarios, objectives, or preparations for the Exercise; (2) questions that address pre-Exercise LERO training; and (3) questions that address post-Exercise training unrelated to specific events of the February 13,1986 Exercise raised in Contention EX50,
- 13. Because Intervenors will begin taking depositions from LILCO personnel on or about December 8,1986 LILCO respectfully requests this Board to expedite other parties' responses and its ruling on this motion.

Transmittal of Objectives For Shoreham Exercise This is to trans:*.it proposed objectives for an exercise of the Lorg Island Lighting Conpany (LILCO) Transition Plan for offsite preparedness The at the Shorehan Nuclear Power Station in Suffolk County, New York. objectives were generated by the Regional Assistance Committee Chairman in Federal Emergency .tna;;ement Agency (FEMA) Region II. Marked by an asterisk, for your information, are the objectives which are related, in cur view, to the legal authority issue and State and local participation. Please transmit this information to the appropriate LIICO representatives, in preparation for the first meeting with the utility on the exercise process. This is ncu scheduled to take place on Morday, November 25, 1985. At the meeting, we plan to discuss the proposed objectives, as a basis for the requireients for the exercise scenario. In order to provide nore realism to the Shorehan exercise, w3 would like to see a considerable amount of free play activities including the followirg :
' Activation of traf fic control points (TCP). Federal evaluators will provide the Exercise Controller infornution on the location of traffic control points to be demonstrated during the exercise.
The Exercise Controller will then request the deTonstration of the TCP activation.
- Impediments to Evacuation. Federal evaluators will introduce free play events to test procedures for the renoval of impediments fran evacuation routes. The denonstration will include the actual dispatch of an emergency vehicle to the scene, rep 3rt fran the scene to the ECC requestirg apprcpriate resources, ECC requestirg apporpriate resources (e.g., tow trucks, gasoline trucks, etc.), estimatirg the time of arrival at the scene and for clearirq the impedinent. EOC staff will be expected to quickly analyze the situation and select an alternate evacuation raate, if required.
In addition, an appropriate EBS massage should be issued to inform the public abcut the impedient (s) . 790611
' Bus Evacuation Routes. Federal evaluators will indicate which bus routes are to be 'denenstrated durirg the exercise. Upon notifica-tion by LIIf0's Incal Emergency Besgonse Organizaticri (LERO), bus drivers will assemble at their dispatch location, be assigned apprcpriate rcutes, be briefed and deployed in accordance with the appropriate procedures. Upon ccmpletion of the routes at the transfer points, the buses and drivers will then proceed to reception centers. The bus routes selected for dertonstration on the day of the exercise will include school evacuation routes.
Students will not be moved for purposes of this de onstration.
' Evacuation of Non-Institutionalized ebbility-Impaired People. '
Federal evaluators will select several addresses of rrobility-impaired persons within the 10-mile EPZ. A vehicle for the transportation of the handicapped will be dispatched to these addresses for simulated evacuation. No handicapped evacuees will be picked up for purposes of this denonstration.
' Evacuation of Institutionalized Mobility-Impaired Pecple.
Federal evaluators will select at least one special facility , with mobility-impaired persons within the 10-mile EP2. A vehicle for the transportation of handicapped will be dispatched to this s;ecial facility. tb handicapped evacuees will be moved for purposes of this demonstration.
*Back-up Notification Systen. Federal evaluators will introduce free play, simulatirg a limit'ed failure of the siren system. It is expected that LERO will demonstrate an effective use of the back-up notification system (e.g. , route alerting) .
Na would like to enphasize the need to provide us with startirg locations and times of all field activities to be denenstrated, in chronological order. A sample forn to record this infocnation will be provided. This is important since FD4A will be evaluatiry the exercise against this~ t imetable. The locations of all field activities includirg an address directory (except free play) should also be indicated on county maps, with an apprcpriate legend. I hope that the enclosed objectives will expedite LIICO's plannirg efforts for the anticipated exercise. It should be stressed to the utility that all exercise scenario material must be kept confidential. I. COMMITMENTS BY LILCO A. The scenario is to be kept strict!'y confidential as it evolves so that no exercise participants have access to it. The letter from John A. Weismantle, LILCO, to November 25, 1985 on this subject (distributed at the meeting) is to be followed by ' another reflecting additional requirements suggested by Stuart Glass Esq. 13,1985. -LILCO is to try to B. It is acceptable to FEMA for the medical drill to be performed out of sync with the exercise scenario, provided that it takes place on the same day as the exercise. FEMA will accept a demonstration of either an onsite or an offsite injury. E. It is acceptable to FEMA that the Red Cross actually demonstrate its capability at no more than one or two locations. F. It is acceptable to FEMA that the EBS station (s) not air exercise messages, provided that the exercise messages all are draf ted as planned ~and a test message is alred. Witnin tne proposed objectives and our subsequent comments, there are a number of items which I would like to bring to your attention. First, is iae subject of Access Control [Ref: pg. 3 of 12, fn. (1); pg. 4 of 12, fn. (2); pg. 5 of 12 fn. (1)]. Here, I would like to point out tnat LERO treats access control to evacuated areas as a subset of traffic control. Access control is provided at traffic control points located on zone boundaries by Traffic Guides performing their traffic control duties. It should be noted that the same constraints on traffic control, related to the issue of legal authority, apply to access. control. Second, security functions at LERO emergency facilities ,are provided by LERO personnel and are tnerefore, not related to legal authority. l Third, on page 6 of 12, we have deleted the last two objectives which are , related to tne demonstration of emergency medical facilities for the ) handling of injured and contaminated individuals. - 1. We will be pe rfoming essentially all t he activities in sequence.
Attachment 1 provides the time frames of each of the activities listed en page 4 of your lette r. If you need to observe something outside of those times, you may need a controller message to ensure that the activities are perfomed at an appropriate observation time. 2. Relative to congregate care, since it is perfomed by the Red Cross by their own authority using their own precedures, we believe it would be appropriate for them to choose any facility with which they have an agreement at the time of the exercise. We believe this would be consistent with how they would function if a real need did occur.
- 3. Bus routes will be run in sequence. We would request that you review with us the method by which you expect to enter bus route free play messages.

- 4. It is our understanding that one school district will demonstrate an appropriate protective action based on the exercise scenario. Furthemore, a FEMA controller may input a scnool transportation assistance free play message. Please note that our procedures (OPIP 3.6.5) identifies which schools by pre-arrangement will need assistance. If your free play message requests assistance at another location, the message will need to detail the location of the school and the reception location to be used.
- 5. We will provice you with the list of homebound . mobility impaired persons by the end of the year. It will include the type of vehicle necessary. This list should be returned to us withcut having been copied and should be held in confidence.

For the mobility impaired at a special facility, we would recommena that one ambulance and one ambulette be used for the demonstration from one special facility. 7. - 6. As we stated in our conversation there is no problem with inputting of siren failure messages,. These messages should be inputted to the Coordinator of Public Infomation at the E0C.
9. As we mentioned to you on the phone, given the scenario, there . is a possibility that tne initial protective actions would be to evacuate two miles around the plant and 5 miles in a cownwind direction. Given our procedures and the wind direction this would cause traffic guides to be dispatched from all three staging areas and bus drivers from Port Jefferson and Patchogue. If this happens, you will need a controller message for the Riverhead bus drivers to be dispatched. 10. As we discussed, LILCO will provide space as defined on page 5 of your letter for Federal Observers. However, we don't believe it appropriate to provide special facilities for the simulators of State and local representatives,
