SUPPLEMENT TO FEMA'S NOTICE OF INTENT TO RESPOND TO SUFFOLK COUNTY, STATE OF NEW YORK, AND TOWN OF SOUTHAMPTON MOTION FOR ORDER COMPELLING FEMA TO PRODUCE WITNESSES TO RESPOND TO DEPOSITION 00ESTIONS, AND TO PRODUCE DOCUMENTS FEMA Counsel hereby supplements the November 18th Notice that noticed all parties that it will respond to the November 18, 1986 Motion of.Suffolk County, the State of New York, and Town of Southampton Motion for Order Compelling FEMA to Produce Witnesses for Deposition, to Permit Witnesses to Respond to Deposition Questions, and to Produce Documents.
In compliance with the standards set forth in LPB-83-72, Long Island Lichtina Company (Shoreham Nuclear Power Station, Unite 1), Docket No. 50-322-OL-3 (Emergency Planning Proceeding) dated November 1, 1983, FEMA Counsel will be furnishing to the Board (1) an affidavit asserting the executive or deliberative process privilege; (2) an index to the list of documents not furnished to Intervenors that fall within that privilege; (3) a statement of precise reasons as to the need to preserve the confidentiality of the documents; and (4) the documents themselves under seal for the Board's in camera review should it be necessary non or before December 1, 1986. Counsel for FEMA further notes that its response to the November 18th Motion to Compel by the Intervenors will be provided on November 28, 1986.
