Justification i
Need for the Information Collection i
10 CFR Sections 30.32(a), 33.12, 34.3, 35.12, and 40.31(a)-indicate how a I
person should file an application for a specific license for possession, use 4
and distribution of byproduct or source material.
In order for a person to be licensed to possess, use, or distribute licensed material, the person must I
complete NRC Form 313. " Application for Material License."
If the information

ation fulfills the substantive requirements stated elsewhere in the regulations, NRC issues a license.
j NRC Form 313 is designed to collect, in one simplified form, information that t
]
was previously collected in five different application forms. Consequently, j
the use of NRC Forms 2, 3131, 313R, and 313T has been discontinued. Guidance
)
for the use of NRC Form 313 by medical license applicants is being developed, and after that guidance is issued, the use of NRC Fonn 313M for medical I
applications will also be discontinued, i
j The economic information which applicants are asked to provide voluntarily on i
Form 313 is needed in order for the NRC to meet the requirements of the t
Regulatory Flexibility Act of 1980.
Under that act, the NRC is required to prepare a regulatory flexibility analysis for any rule that will have a

l significant economic impact on a substantial number of small entities.
Maintaining an accurate economic profile of its licensees will allow the NRC to evaluate various regulatory alternatives that may have less adverse impact on j
small entities.
l-Agency Use of Information i
j The information submitted on NRC Form 313 is reviewed by the NRC staff to j
determine whether the applicant is qualified by training and experience and has equipment, facilities, and procedures which are adequate to protect the health i
and safety of the public and minimize danger to life or property. An application for a byproduct or source material license is usually reviewed by j
J the NRC headquarters or regional materials licensing staff within 30 days of i
receipt.
If there are no deficiencies in the application, a license is issued.
If there are deficiencies, their resolution is by correspondence with the I
applicant.
The average time for issuance of a license if there are l
deficiencies is approximately 60-90 days depending on how quickly the applicant provides the information needed to resolve the deficiencies.
The voluntary economic data is compiled and analyzed by the NRC to obtain an economic profile of NRC licensees. With the ability to identify which types of licensees are large entities and which are small entities, NRC is able to develop more accurate regulatory analyses for new rules affecting those I
licensees. The economic data is also useful in determining whether or not small entities have been adversely affected by existing rules.

However, because of the types of information and the infrequency of submission, the application form does not lend itself readily to j
the use of automated information technology for submission.

The Federal Information Locator System was searched to determine NRC and other Federal agency duplication. None was found.
Effort to Use Similar Information There is no similar information available to the NRC.
Effort to Reduce Small Business Buroen The majority of licensees who use byproduct or source material are small businesses. Since the health and safety consequences of improper handling or 1
use of radioactive byproduct material are the same for large and small entities, it is not possible to reduce the burden on small businesses by less frequent or less complete accounting or control procedures.
Consequences of Less Frequent Cnllection Applications for new licenses and amendments are submitted only once.
Applications for renewal of licenses are submitted every five years, i
Information submitted in previous applications may be referenced without being f
resubmitted. The schedule for collecting the information is the minimum I
frequency necessary to assure that licensees will continue to conduct programs j
in a manner that will assure adequate protection of the public health and safety.

Consultations Outside the Agency There have been no consultations outside'the agency since the previous clearance of these information collection requirements. However, the Small Business Administration (SBA) was contacted regarding the voluntary economic information.
SBA size standards, based largely on number of employees and/or annual receipts, are arranged by specific type of industry.
The M has arranged its program codes by type of use (e.g., measuring devic
'ypes and amounts of source or byproduct material) and, within each code, tnere is often a mixture of different industries.
Because of this, it is not feasible to j
i apply the SBA size standards to NRC licensees for regulatory analyses.

Estimate of Burden Approximately 750 new, 3950 amendment, and 1500 renewal applications for the 4
possession, use, and initial distribution of byproduct and source material are received annually. The applicants range from private individuals to large corporations and federal agencies.
It is estimated that each applicant will spend an average of 8.25 hours2.893519e-4 days <br />0.00694 hours <br />4.133598e-5 weeks <br />9.5125e-6 months <br /> to prepare tne health and safety elements of an application.
Based on an i
anticipated 6,200 licensing actions per year, the total industry burden for licensing is estimated to be 51,150 hours0.00174 days <br />0.0417 hours <br />2.480159e-4 weeks <br />5.7075e-5 months <br />. However, medical applications are not yet able to be submitted on this form, but are instead currently submitted on NRC Form 313M, which is cleared under OMB No. 3150-0041, and which represents 600 responses and a burden of 12,000 hours0 days <br />0 hours <br />0 weeks <br />0 months <br /> annually. Thus, the i

(This is based on an average of 30 minutes per application to complete only the economic data.)
