Dear Chairman Zech:

I am deeply disturbed by published reports that there has been a leax f rom the NRC to industry regarding the Commission's notation vote reversing the Atomic Saf ety and Licensing Appeals Boara decision on the ALAB-853 issues pertaining to emergency plans.

It true, this unfortunate event once again raises questions about the appropriate distance to be maintained between Commission employees and the licensees they are enarged with regulating.

Particularly in light of recent revelations, one would have expected the Commission to be especially sensitive to any further actions that might be interpreted as f avoring the interests or a licensee over the interests of the public.

Accoroing to the reports, af ter the completion of the notativn vote but prior to the Commission's April 9 af firmation session, an industry loobyist contacted both the Office of the Executive Director for Operations and the Office of General Counsel and attempted to find out what information he could provice to Commissioners to convince them to support the position of Public Service of New Hampshire, the majority owner of Seaoroon.

If true, this clearly indicates that the lobbyist in question knew the outcome of the vote prior to its affirmation or announcement.

Such knowledge would constitute an advantage to the utility.

Such an. aavantage appears to be evidenced by the utility's filing a _ motion only days bef ore the af firmation session l

which was obviously designed to circumvent possible problems raiseu by an adverse Commission decision on the ALAB-853 issues.

Please provide a complete chronology of all communications regarcing the Commissioners' notation votes (individually or co lectively) on the ALAB-853 issues between (a) any NRC employee l

working in the otfices of the EDO or OGC, or any other employee of the NRC, including Commissioners and their staf fs, and (b) any employee or representative of the Seabrook licensee or any other NRC licensee or of a nuclear industry trade association.

In each case provide the names of the participants, the date, an inoication of who initiated the communication, and a summary of y
