This is to confirm the discussion Mr.. Jack W. Hornor, NRC State Agreement Representative, held on October 27, 1986, with Mr. Stanley Cubanski, i

Dr. Harvey Collins and your staff following the conclusion of our follow-up review and evaluation of your' commitments to the State's radiation control program subsequent to our March, 1986, routine review.

-The results of our review indicate that the California radiation control program is adequate to protect the public health and safety.

However, while we commend the work the State has put forth in updating the majority of its regulations,nthe process is not scheduled for completion until February,1987, and we are,-therefore,4 unable to offer a statement of compatibility until that time.

We found the issues that had concerned us in management, personnel, licensing, and compliance had, for the most part, been satisfactorily resolved.

Significant improvement was noted in the status of the inspection program.

A computer system has now been developed that provides an accurate tracking system for the inspections, and the program has been able to stay on the action plan schedule for eliminating the backlog of overdue inspections. We were also pleased to note the increase in professional staff and your plan to bring the staffing level up to the NRC guidelines in the next budget proposal.

There is still a problem in the Category II Indicator, Office Equipment and Support Services.

The radioactive materials program does not have the clerical support necessary to carry out the routine licensing and compliance load, a finding that is repeated from the last two reviews.

Moreover, this situation has deteriorated since the last review, and as a result important actions do not reach the licensee for as long as three months.

This matter requires your immediate attention.

We are pleased overall with the continued improvement we find in the California radiation control program, particularly since your appointment to Director, Department of Health Services. With your help and direction, the program and direction now meets most of the NRC review guidelines.

Please review our comments and provide any necessary revisions, with target dates, to your action plan.
