As a citizen and an intervenor in the Limerick lice pagyrocess g ry under the same R.L.lathony/ FOE, I hereby petition the imipa, fort immediate action on my submissions which j,etitiendf the 5tAsmiesion for suspension of the operating license issued to Philadelphia Electric Co,(NPF-39). I as petitioning under 10 CFR Sec.132. This section provides General Counsel review of " petitions received from memberr of the public seeking direct Commission action".I ask for direct acties.

I further petition the Commission to inattute action for an immedi-ate hearing on the suspension of the Limerick operating license for cause as provided under 100FR Subpart B and under 10CFR 50.100.

As your records show,I' petitioned.,,'t Commission on2/27/06for action under 10 CFR 50.100 gor suspension of the license because of safety hasards in the plaats operation due to plant and staff and maa-agement defeciencies,as well as violations of the provisions and require-meats of the license . I have followed u ith further evidence for suspension of the license,the latest on 8/p 21 w/86 which included a n matter in the form of a letter from Mr.Bernero to Mr.Bauer, 8/5/86, which appearre to cast doubt on the licensee's submissions which formed the basis on which the license was granted This letter is enti-tied " CONTINUED OFERABILITY OF LICENSEE STATEMENTS", and provides examples of the licensee's unreliability la "ststements previously made

It seems to me inexcusable that my petitions with their evidence

, on which the license should be suspended were shunted to the staff l and there bottled up by directors' decision to take no action under 10CFR 2.206. I again protest this abuse by omaission and denial of j a citicen's rights to protect his health and interests.

It is also inexcusable that my petities of 3/5/86 to the Commission for suspension of the license because of violation of the requirements of the license in the changes of cooling water intake from the Schuylkill was also shunted to the staff and has been bottladup, disregarding the lack of responsefromPECotoMr.Bernero'srequestof6/17/86andmysubmission of further detailsefthe violations on 7/7/86.
