Unit 1 Docket No. 50-322-OL-5 EP Exercise

Dear Messrs. Johnson and Pirfo:

On Monday, May 18, your cross-examination of Dr. Charles Perrow, a witness for Suffolk County in the above proceeding, was cut off in order to permit Dr. Perrow to maintain his travel schedule. At that time, you made an offer of proof, and counsel for Suffolk County expressed the County's willingness to bring Dr. Perrow back should the Board so request. (See Tr. 6476-80.)

The Board is considering whether to request that Dr. Perrow return.

In this connection, we would appreciate your advice as to whether staff believes that a further opportunity to examine Dr. Perrow is necessary in order to avoid prejudice to the staff's position and, if so, approximately how much time staff believes would be required to complete its examination.

We would appreciate your advice by Thursday, June 4.

Sincerely, J hn H f-A IN MTIVE JUDGE cc: Service List e706020063 870528 "
