TOWN OF HAMPTON MOTION FOR PROTECTIVE ORDER NOW COMES the TOWN OF HAMPTON, pursuant to 10 CFR S2.740 (c), and moves this Board to enter a Protective Order that the TOWN OF HAMPTON shall not be. required to produce Glen French, Executive Director of the Town of Hampton Chamber of Commerce, for deposition.
In support of this Motion, the TOWN OF HAMPTON. relies upon the Affidavit of Town of Hampton Counsel Matthew T.
Brock filed herewith and incorporated by reference herein.

My name is Matthew T. Brock, counsel for the Town of Hampton in the case of PUBLIC SERVICE COMPANY OF NEW HAMPSHIRE, et al, (Seabrook Station, Units 1 and 2), docket Nos. 50-4430-OL and 50-444-OL.

I submit this Affidavit in support of TOWN OF HAMPTON MOTION FOR PROTECTIVE ORDER.

On May 20, 1987, the Town of Hampton was served with APPLICANTS' NOTICE OF DEPOSITION OF GLEN FRENCH which provided, inter alia, the deposition of Glen French would be taken by Applicants on Thursday, May 28, 1987, at 11:00 A.M.,
as set forth on the attached Notice of Deposition filed herewith and incorporated by reference.

To the extent Applicants seek to compel the Town of Hampton to produce Glen French for deposition, that request should be denied since Applicants have already served upon the Town of Hampton interrogatories requesting substantially identical information to that which Applicants seek to obtain through deposition of Mr. French on the Town's population estimates.
Applicants # interrogatories on this issue seek all information permitted by court rules f rom the Town 's expert.
Applicants' request for a deposition of Mr. French is therefore redundant, beyond the scope of discovery pursuant to court rules, and Applicants have made no showing to justify the additional deposition request in this case.

As alternative grounds for this motion, Glen French has volunteered his information on population estimates for the Town of Hampton in these proceedings.
Glen French has not been retained by the Town of Hampton.
The Town of Hampton is therefore without authority to direct Mr. French to appear for deposition.

at the offices of Sheehan, Phinney, Bass & Green, Hampshire Plaza, 1000 Elm Street, Manchester, New Hampshire.
The matter for examination is the use of population estimates by the Town of Hampton Chamber of Commerce.
The deposition will be taken before an officer duly authorized to administer oaths.
