) September 9,1986 MEMORANDUM AND ORDER MEMORANDUM (Questions About Cygna's Continuing Role)

On August 28, 1986, Texas Utilities Electric Company, et al.

(Applicants) transmitted to this Board a letter of August 26, 1986, from Applicants' President to Mr. Richard J. Stuart, President of Cygna Corporation. In that letter, Applicants stated:

Since the Cygna review effort at Comanche Peak was first initiated in 1983, numerous developments have taken place. . . . Consequent-ly, for all practical purposes, the Cygna effort, as it was origi-nally conceived, has been superseded by a much larger and more comprehensive program.

This statement causes some concern to this Board because both the Staff of the Nuclear Regulatory Commission and this Board had approved of Cygna as an independent design review organization in order to

Cygna Independence: 2 CPSES."1 Initially, we approved Cygna over the objections of Citizens Association for Sound Energy (CASE).

At first, Cygna's testimony followed guidelines developed between it and Applicants and made findings generally favorable to Applicants' design. However, Cygna's witnesses always testified in a manner that we consider forthright and helpful. Witnesses Bjorkman and Williams were particularly helpful. Their technical testimony was so carefully presented and technically persuasive that Jack Doyle, a CASE witness, withdrew some of his prefiled testimony based on analyses of these witnesses.

As time passed, it became clear that Cygna is an organization with high integrity and competence. Particularly within the scope of matters with which they have become familiar, we desire them to complete the task they began and to assure this Board that the aspects of design with which they have been concerned have been adequately resolved.

For that reason, we have decided to ask Applicants to set forth their views concerning the present role of Cygna, the extent to which that role should be modified from what the Board has approved, and the reasons why the Board should approve that modification. The other parties and Cygna will be asked to respond.

e Cygna Independence: 3 0RDER For all the foregoing reasons and based on consideration of the entire record in this matter, it is this ninth day of September 1986 ORDERED:

1. That Texas Utilities Electric Co., et al. shall file a state-ment of their views concerning the present role of Cygna, covering the subjects set forth in the attached memorandum, by September 26, 1986.
2. Citizens Association for Sound Energy shall respond by October 3, 1986, and we request Cygna to respond on that same date.
3. The Staff of the Nuclear Regulatory Commission shall respond by

4. The Board will approve any alternate procedure that meets its purposes and is agreed to by the parties and Cygna.
