hington, D.C. 20555 ir Mr. Otainaan:

As you know, on April 8,1986 the House Ehergy and Envirorunent x:cannittee held a hearing dealing with the effect of the January At

thquake on the safe operation of the Perry nuclear power plant.

it hearing, the enmanissioners refused to testify, stating that they i not want to " prejudge" any of the issues involved in the Perry

~,]

ensing process.

at However, on April 18, 1986, the Camaission vacated the Atcenic h

!ety and Licensing Appeal Board's order for an exploratory " mini-1 ring" to gather more information about the safety significance of e earthquake. Conmissioner Asselstine described the Commission's tions as "just another illustration of the Canaission's distaste for e hearing process and for public partici;ation in that process."

Imediately following the Casaission's actions to vacate the peal Board's order for a " mini-hearing", Chio Citizens for Re-onsible Energy (OCRE) filed a Freedom of Information Act (EVIA) quest with the Comnission for various records pertaining to the mission's actions to vacate the Agnal Board's order. Although the i

mission refused to release the requested documents, the Comnission d release a listing of the documents.

Included on the list is a aft order dated April 8,1986, the same day that the Comission ifused to testify before the Dargy and Envirorment Subconnittee.

her haamants on the list are tmdated, and could have been prepared ill in advance of the April 8 Congressional hearing.

'Ihe coincidental timing of the April 8 deaf t order on the same my as the Congressional hearing leaves the distinct impression that to Canaission was attenpting to deliberately thwart Congressional I

tersight activities by refusing to testify at the April 8 hearing.

@ect the Comnission to explain the chain of events leading up to its x:1sion to vacate the Aspeal Board's order, and I expect that the

maission will release to the House Interior Cmunittee the documents
pearing on the attached list so that the Cannittee may carry out its ters1#t & ties.
