TOWN OF IIAMPTON RESPONSE AND OBJECTION TO MEMORANDUM AND ORDER E TE APPEAL BOARD DATED AUGUST JL.1986 --

By its Memorandum and Order dated August 11, 1986, the Appeal Board has requested a response f rom each party on the Appeal Board's proposal to require immediate appeal of the Licensing Board's rulings on the admission or rejection of contentions on the New Hampshire Emergency Plan, as set forth in the Licensing Board's orders of April 29, 1986 and May 21, 1986.

The Town of flampton objects to the Appeal Board proposal on jgrounds:

1)

Assuming that the Licensing Board declines to approve the New llampshire Radiological Emergency ~ Response Plan (Plan), any error by the

' Licensing Board in failing to admit certain contentions of the Town of flampton, or other int. crested parties, may be rendered moot.

2)

The State of New llampshire has advised all parties of its

! intention to substantially modify the present plan, through submission i

Revision 2 has yet to be filed or served upon the parties, and this amended plan may render moot certain contentions previously ruled on by the Licensing Board in its April and May orders, and/or require the

.! filing of additional contentions.

Indeed, the Town of Hampton

! previously filed a Motion to Continue the Licensing Proceedings precisely because the New Hampshire Plan remained substantially incomplete.

The Town should not now be required to appeal contentions, and incur the expense for same, when these appeals may be j

rendered irrelevant by -subsequent amendments to the Plan filed by the I

State.

3)

The Town presently has pending before the Licensing Board an additional and detailed contention on the KLD Evacuation Time Estimate Study, and may file additional contentions based upon the State's Revision 2.

It is wholly unreasonable f or the Town to determine,. based upon an incomplete record, those contentions on which it should expend its limited resources to preserve its appeal rights.
