The NRC Staff adheres to its position that no environ::nntal conditions am neces-sary for the Marble Hill site in its Response to the Atomic Safety and Licensing Board Order of May 30, 1986 requesting additional information on the matter of term-ination of the Marble Hill Proceeding.

The NRC Stcff asserts that it has clarified its position as to why it believes no conditions for site mstoration or stabilization am necessary by inclusion of an affidavit of Dr. Robert B. Samworth affirming that the Staff had made a site inspec-tion, found that Public Service Indiana had recognized the creas of high erosion potential cnd taken mnedial action to pmvent erosion.

Sassafras..udubon has asked in previous communicctions that Public S'rvice Indiana be required to restom the Marble Hill site as completely cs possible to its pre-construction state with the land available for farming, timber end wildlife habi-tat. To repair and prevent erosion at Marble Hill is important and commendable, but is no answer to vhat is meant by the term " site restoration".

Marble Hill was in an advanced stcte of construction when it was canceled, and to require only erosion control is to let Public Service Indiana walk away with vir-tually no responsibility for what is left behind. The Marble Hill nuclear plant i

were of significance in astoration of the Clinch River site, then they should ap-ply equally to Marble Hill.

In the instance of Clinch River an objective was to mstom the site to a con-dition that made it suitable for industrial use. This may have been acceptable for Clinch River, but the location of the Marble Hill site does not lend itself to de-velopment, Publi6 Service Indiana has indicated no plans for use of the site, and it is highly unlikely in the forseeable,futum that any other utility would be in-temated in the site for power generation.. Indiana has an excess of pouer and pre-dictions are for Indiana's population to decmase somewhat, a continuing trend, rather than to increase. Valley maidents are also likely to vigorously oppose its use as an industrial site because of current air pollution problems.

'.4 hat would it take to demolish Marble Hill? Public Service Indiana has made a notable recovery from its former pmcarious financial strait because of the granting of rate inemases by a PSI-supportive Public Service Connission, a few acts of re-tmnchment, and various financial arranE ments.

It should be able to provide for clean-up of the site.ithin a masonable period of time.

Sassufras r.udubon will oppose any decision which allows Public Service Indiana to talk a. icy from Marble Hill without concern for the land-use of this thousand-r.cre site. Such a decision would in itself be en irresponsible act.
