SUBJECT:
PROCESSING OF ENFORCEMENT CASES To further the understanding of the mechanics of the enforcement process I met with members of your staff on May 19, 1987 and also have enclosed two documents describing in general our interfaces with the regional offices and NRC program offices (NRR/0GC). Enclosure 1 describes various facets of the enforcement process and focuses on regional actions. Enclosure 2 is an outline of the issues for proposed enforcement cases which we feel the program offices should be addressing.
In the interest of time, oral or hand written views are adequate.
Formal memos are not required provided the views provided reflect the NRR position.
You should be getting the enforcement package directly from the region at the same time that OE obtains them. Based on our discussions on May 19, 1987, for reactor enforcement cases NRR will contact the Office of Enforcement [Howard Wong (operations / construction), Ed Flack (health physics), Perry Robinson (safe or Gene Holler (wrongdoing / DOL)] within 2 days of the date of receipt of a' guards),
case to give the name of the appropriate NRR contact.
If we receive no information regarding a NRR contact, we will contact the appropriate NRR Division Director for Reactor Projects (Varga/Crutchfield).
If we have not heard sooner we will contact the designated NRR contact 3-4 days later to obtain the NRR connents.
j If by that time there are no connents, we will proceed with processing the case.
Obviously, if in such a case, NRR management provides me significant connents before the case is issued, they will be considered. But to make the system work on a timely basis we will need to get NRR comments for routine cases in 5 to 6 days from the date of the receipt of the case.
As the enforcement process evolves, we will evaluate changes to this approach as appropriate. Your connents or questions are requested.
In addition, as we discussed I would be pleased to provide training on enforcement to your staff.
