Dear Senator Humphrey:
Thank you for your letter of April 2,1987 expressing support for the NRC's actions at the Peach Bottom Atomic Power Station.
The Commission believes that reactor operators are-a key element in ensuring the safety of nuclear power plants and that any action on the part of operators that places the plant in jeopardy cannot be tolerated.
The NRC shares your concerns regarding the problems that have been identified at Peach Bottom.
We are determined to see that these problems are resolved prior to restart of Peach Bottom.
You also commented about the Seabrook plant.
I hope you will understand that the Commission may not comment on the substance of the Seabrook emergency planning issues so long as those matters are before the Commission or its adjudicatory Boards for resolution.
Any resolution must be made on the record of the Seabrook proceeding.
For your information, we will serve your letter on the parties to that proceeding.
With respect to Public Service Company of New Hampshire's request for a waiver of the regulation establishing the size of the emergency planning zone, that request was found insufficient by the Licensing Board that considered it.
Lacking a favorable determination that a prima facie case has been made, the waiver request will not receive further Commission consideration on the I
merits.
I assure you that we will continue to take the. steps necessary in j
regulating nuclear power for the protection of the public health and safety.
Commissioner Roberts did not participate in this response.
