SUBJECT:
REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE By your letter and affidavit dated October 27, 1966, you submitted "A Description of the Combustion Engineerino 2825 PW(t) System 80 Nuclear Steam Supply System" and"Discussionof2825MW(t) System 80NuclearSteamSupplySteam,C-E/NRC Meeting, October 24, 1986" and requested that the letter and the documents be withheld from public disclosure pursuant to 10 CFR 2.790. Subsequently, a non-proprietary version of the transmittal letter was forwarded November 10, 1986.
You stated that the submitted information should be corsidered excmpt from mandatory public disclosure for the following reasons: The information is of d type Customarily held in confidence by Combustion Engineering (CE), is not available in public sources, its disclosure would likely cause substantial harm to the competitive position of CE and its development is the result of substantial effort dnd considerable sum of money.
We have reviewed your application and the material based on the requirements and criteri6 of 10 CFR 2.790 and, on the basis of your statements, have determined that the submitted information sought to be withheld contains trade secrets or prcprittary commercial information.
Therefore, the documents discussed above have been designated as proprietary and will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.
If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the dppropriate agreements for handling proprietary information.
