Dear Dr. Bernstein:

Thank you for your letter of October 21, 1986, responding to our comments and recommendations following our 1986 review of your Department's radiation control program.

We will look forward to receiving a notification from Mr. Lacker of the date when the Texas Board of Health adopts the two regulations, identified during the review, that are deemed to be matters of compatib:lity. As stated previously, we will be prepared to offer a finding of compatibility for the program at that time.

With respect to major licensees needing contingency plans, w were pleased to learr through discussions with Mr. Lacker and his staff that steps are being taken to identify licenseas needing such plans to assure that elements of such plans have been addressed by the licensees. We also understand that Texas does not plan to require preparation of such plans as separate documents until rulemaking for such requirements is completed. As you know, NRC staff' has proposed rulemaking on this matter and the staff will receive additional Commission direction on this matter.
