SUBJECT:

ALLEGATION NO. RIV-86-A-060 We are in. receipt of your letter dated April 29, 1987 on the above subject.

We have obtained a complete copy of the " Findings of Fact and Conclusions of Law," in Civil Action No. 4-81-317-K in the United States District Court for the Northern District of Texas, Fort Worth Division. A copy of this document along with your April 29, 1987 letter and this letter will be provided to ASME for their information as well as the current patent holder for E-Brite, Allegheny Ludlum Steel Corporation'.

We are continuing to pursue your concerns with ASME, the BOC Group, and Allegheny Ludlum and will keep you informed of any significant findings.

With regard to your request for a "... complete return of all original evidence i

furnished and that no records remain within the NRC files of my allegations,"

we cannot comply with your request to purge our files of all copies of the documents you delivered to the Nuclear Regulatory Commission, Region IV office in July,1986 as we need these documents to complete our review of this issue.

However, if ycu would like a copy of those documents, please let us know and we will send you a copy.
