LILCO'S ANSWER TO INTERVENORS' MOTION TO REOPEN RECORD OF NOVEMBER 10. 1986 On October 15,1986, the Intervenors in this case filed their "Suffolk County, State of New York and Town of Southampton Motion to Reopen Record" with the Li-censing Board. The Motion sought to open the record on the issues of the Red Cross's statement that its letter to LILCO about staffing congregate care centers was a state-ment of policy rather than an agreement, of WALK radio's withdrawal from the emer-gency plan, and of several congregate care f acilities' announcements that they would not be a part of the plan. LILCO responded with an Answer of October 27,1986.
On November 5,1986, the Licensing Board ruled that it lacks jurisdiction to de-cide the Motion to Reopen and that the Commission is the appropriate forum. Accord-ingly, the Intervenors reflied their "Suffolk County, State of New York, and Town of Southampton Motion to Reopen Record" with the Commission on November 10, 1986.
This is LILCO's response to the refiled Motion.
LILCO agrees with the Intervenors (November 10 Motion at 4) that no purpose i.
would be served by retyping the pleadings already filed. Accordingly, LILCO stands un the arguments in its pleading of October 27,1986, entitled "LILCO's Answer to Suffolk County, State of New York and Town of Southampton, Motion to Reopen Record of 86112^0148 861120 c0 3 PDR ADOCK 05000322

October 15,1986." LILCO would add little more than a reference to the Commission's November 7,1986, decision in the Perry case, which was not in existence when LILCO's October 27 pleading was filed:
The Commission recognizes that its standards for re-l opening and the way that they are to be applied set a high, al-though not insuperable, barrier to reopening a closed proceed-ing. This policy is fully consistent with the approach taken by the United States Supreme Court and the Courts of Appeals that f avors finality in administrative proceedings. See, e_.1, LBowman Transportation. Inc. v. Arkansas-Best Freight Systems. Inc., 419 U.S. 281, 296 (1974); Interstate Commerce Commission v. Jersey City. 322 U.S. 503,514-15 (1944);
Oystershell Alliance v. NRC. 800 F.2d 1201 (D.C. Cir.1986).
The policy recognizes that once the administrative record has closed, NRC resources should not be diverted from conducting relevant safety studies into preparation for reopened hearings i
unless there has been a strong showing that reopening is justi-fled. In accordance with this policy, the Commission has on several occasions stepped into adjudicatory proceedings be-

motion rather than order an exploratory hearing which would further expend the resources of the NRC staff on hearings i
rather than on technical safety study and reviews.

the issue of congregate care centers do not rise to the level of issues that are important i
enough to divert the Staff from its other health-and-safety duties. These issues involve providing people with food, clothing, and shelter af ter they have lef t the EPZ and, if necessary, been monitored for radioactive contamination. While this is a function that l
cannot be ignored and would certainly be important to people needing these services in l
an emergency, it is not central to the NRC's main concern of protecting people from

3 radiation. Also, it is hard to take seriously a claim (if indeed one is being made) that the Red Cross would be unwilling to care for evacuees or that the doors of schools and churches would be barred to evacuees in a real emergency.
In short, LILCO urges the Commission, for the reasons stated in its October 27 Answer, to decline to reopen the record on congregate care centers and the role of the Red Cross.
