Secretary to lead us through the items to affirm, do any of my 7
fellow Commissioners have any comments or. opening comments to 8
make.

COMMISSIONER BERNTHAL:
Well, there is only one e
10 item, and that concerns the agreement between the NRC and i

11 Illinois, giving them agreement state status, and I.would just!
12 say, as my colleagues know, I think that we've made a rather I
!(
artificial distinction here that has little basis, technical 13 14 analysis at least, between source and byproduct material.
I'm 15 not quite sure whose purpose it serves, if anybody's.
16 I would have preferred that we do something more J
l 17 consistent on that, but I am delighted.that we are finally 2
18 getting this thing out.
And I guess that's enough said.
19 CHAIRMAN ZECH:
Well, I think we're all delighted 4
l 20 that it's getting out.

The item is SECY 87-104.
It is a 1
23 proposed agreement between Illinois and the U.S. Nuclear 24 Regulatory Commission.

entering an agreement with the State of Illinois pursuant to

.2-Section 274 of the Atomic Energy.Act as amended, to issue an
'3 order which retains NRC jurisdiction over the possession and ll use of source' material by Allied Chemical Corporation, 5
Metropolis, Illinois.

-Chairman Zech, Commissioners Bernthal and Carr have I-7 approved the order, as modified by Commissioner Carr, for the 8
NRC to retain jurisdiction over Allied Chemical Corporation.

Commissioner Asselstine, who is not here, has i
i 10 disapproved the order.
