Assistant Associate Director Office of Natural and Technological Hazards Programs SUBJ ECT: Ohio Association of Public School Employees Pesolution Related to Of fsite Emergency Preparedness at Davis-Besse The U. S. Nuclear Requlatory Commission (NRC) requested on November 10, 1986, a response frm the Federal Emergency Management Agency (FDiA) on the Davis-Besse offsite radioloqical emergency preparedness issues raised in the October 20, 1986, resolution of the Ohio Association of Public School Employees (OAPSE), Northwest District; and in the Second Cause of Action in the " Petition of the Toledo Coalition for Safe Energy and Susan A. Carter for Pevocation, Modification, or Suspension of Operating License Per 10 CFR S 2.206."

Attached is a status report prepared by FEMA Region V which outlines action that has been taken, or is beinq planned, to address the issues raised in the OAPSE resolution and in the S 2.206 petition. Ohio Disaster Services Agency (OWA) reports to Region V have indicated that despite the OAPSE resolution, the employees of the Lucas County /Oreqon School System, the Benton-Salem-Carroll Township School System, and the Port Clinton School System have generally shown a willinaness to be trained and to otherwise participate in the Davis-Besse offsite radio-loqical emergency planning and preparedness program. In spite of the OAPSE resolution passed by the Northwest Chapter, it does appear that school employees are willinq to cooperate, attend meetings, and par-ticipate in training related to their mergency duties ( school bus drivers, secretaries, food service workers, custodial staf f, etc.).

'Ihis nemorandum is a status report of the actions taken by the Toledo Edison Conpany and the State of Ohio in response to the above petition to the Nuclear Regulatory Connission. %c Susan A. Carter Petition references the passage of a non-binding resolution by the Ohio Association of Public School mployees, Ancrican rederation of State, County, and Municipal Diployees, AFL-CIO (OAPSE-AFSCME), to not participate in planning or evacuation in case of an e:rergency at the Davis Besso Nuclear Power Station. The petition further states that "the passage of the resolution by the union raises serious questions and doubts as to the efficacy of existing energency plans for Davis Besse, as extensive reliance is placed upon the use of school bus drivers and volunteer drivers to transport children and adults with special transportation needs from the energency planning zone in the event of a nuclear accident at the DBNPS."

Susan Carter and the Toledo Coalition for Safe Energy further denand that the Director of Nuclear Reactor Regulation and/or the full Nuclear Regulatory Conmission require Toledo Edison Conpany to show cause why its ooerating license for the DBNPS should not be suspended or terminated. They further derranded the NRC issue an itmediato order restraining the DBNPS from its contenplated Novenber 4,1986 restart, or any other contenplated date for the startup of the plant pending full adjudication of the issues raised in the petition. Outlined below are the actions reported to TEMA Region 5 by the Ohio Disaster Services Agency in response to the OAPSC-AFSCME resolution.

INTRODUCTION!

Wo Ohio Disaster Services Agency reported to FEMA Region 5 that they and the Toledo Edison Conpany are in the process of setting up nectings with appropriate ochool systera to discuss the Susan A. Carter petition and to conduct further training of school enployees who would be required to perform errergency duties in the event of an energency at the DUNPS.

Reflected below is the status of these neetings as reported by the Ohio Disaster Services Agency.

  • P.03 DOV.11 '66 09:27 FEMA REGION V CHICAGO 1 OCMBER 22, 1986:

The Toledo Edison Conpany and the Ohio Disaster Services Agency conducted a necting with Lucas County / Oregon school systen. Superintendent and union (OAPSE-AFSCME) representatives for school enployees. This was an initial neeting to discuss the petition and to determine if additional training is desired by the enployees of the Oregon school system.

OCMBER 31, 1986:

A staff nember of the Ohio Disaster Services Agency met with the lawyer for the school enployees. The 00SA staff nenber outlined the liability issue as it is covered in 5915.10 of the Ohio revised code which provides that school bus drivers are not liable if work is perforned under an approved plan.

Other legal issues such as workaen conpensation were also discussed. The ODSA staff nenber felt the lawyer was satisfied that school bus drivers and other school enployees are provided legal protectrion if they perform duties during an energency at the DBNPS.

NOVDOER 4,1986:

We Toledo Edison conpany and the Ohio Disaster Services Agency not with school bus drivers, custodians, food service staff, and union representatives of the Lucas County / oregon school system. The Ohio Disaster Services Agency further reported that the attitude of the school system enployees toward their role in energency preparedness was positive and that the newspaper articles did not accurately depict their attitude concerning the resolution passed by the OAPSE-AFSCME. Approximately 30 people attended this neeting.

NOVEMBER 5, 1986:

The Toledo Edison Conpany and the Ohio Disaster Services Agency net with school bus drivers, food service staff, custodians, and union representatives from the Benton-Salem-Carroll Township school system. We attitude and results of this neeting were similar to those brought out by the school enployees of the Lucas County / Oregon school system neeting of Novenber 4,1986. A training neeting was established for November 13, 1986. Approxinately 60 people attended the Novenber 5,1986 neeting.

NOVDEER 6,1986:

We Toledo Edison Conpany and the Ohio Disaster Services Agency net with all superintendents and principals in Ottawa County. This was an orientation neeting to discuss the petition and to explain the logic of using school buses for transporting citizens needing transportation in the event of an accident (i.e. nursing hones and hospitals). Also discussed was the legal requirenent of bus drivers to initially provide transportation in the event of an evacuation; legal liabilities should bus drivers be involved in an accident while functioning under an approved plan; and whether or not school bus drivers are legally required to return to the 10 mile EPZ to provide transportation for transportation dependent citizens. It was pointed out this was done on a voluntary basis once the school children were evacuated.

NOVDSER 13, 1996:

! No training neetingit have been established. The first is for the t.ucas  ;

County / Oregon school system and the second is for the Benton-Salenr-carroll

! school system. These training nestings will be conducted concurrently at

! the Joint Public Information Center at the Davis Besse Nuclear Power Station i for Ottawa County and at the Fassett Junior High School, 3925 Star Avenue, i Port Clinton, Chlo for Lucas County. The Ohio Disaster Services Agency will 1 provide FD1A Region 5 with a copy of the training program. The Ohio 4 Disaster Services Agency estinetes approximately 49 people will attend from Lucas County and approxinately 69 from Ottawa County. '

NOVDBER 17, 1986 Approxinetely 39 City of Port Clinton school bus drivers will attend the 4 i hour training program. The training will be conducted jointly by The Ohio Disaster Services Agency, The Toledo Edison Conpany and the Ottawa County Disaster Services Agency.

NOVDSER 19,__19_861 An initial neeting will be held by the Toledo Edison Conpany and the Ottawa County Disaster Services Agency with Ottawa County school systens outside of ,

the Davis Besse 18 mile energency planning zone (i.e. Wooducre, Danbury, Genoa, etc ). c In spite of the resolution passed by OAPSE-AFS m E, Northwest chapter, it does appear that school enployees are willing to cooperate, attend neetings and participate in training related to their energency duties (school bus j drivers, food service, custodial, etc.) in the event of an emergency at the i Davis Besse Nuclear Powar Station. In addition, It should be pointed out j that school refugee recqtion centers as part of emergency evacuation plans for DBNPS are outside the 19 mile EP2. Therefore energency workers, paid or

volunteer, are not subject to the same hazards as those emergency workers
performing duties within the 19 mile EP2.
