PROCEEDINGS i

2 CHAIRMAN ZECH:

Good morning, ladies and gentlemen.

3 This is an affirmation session on one item.

I will ask the 4

Secretary to read off the item and lead us through the matter.

5 SECRETARY CHILK:

Before I do that, Mr. Chairman, 6

may I ask the Commission to vote to hold this matter on less 7

than one week's notice, please?

8 (Chorus of ayes.]

9 SECRETARY CHILK:

The subject is SECY-06-320, the 10 Commission decision in the uranium miller's hearing.

11 The Commission here is being asked to act on an 12 order which terminates a hearing in the matter of American 13 Nuclear Corporation on amendments which would impose a 14 groundwater monitoring program on each of the involved uranium 15 millers licenses to ensure compliance of 40 CFR 192.34 (a) (2),

i 16 a regulation promulgated by the EPA.

17 Chairman Zech, Commissioners Roberts, Asselstine, 18 Bernthal and carr have a approved the order which terminates 19 the hearing since the matters which the millers sought to 20 litigate were issues already decided by Commission rulemaking.

21 Would you please affirm your votes?

22 (Chorus of ayes.]

23 CHAIRMAN ZECH:

Are there any other matters to come 24 before us today?

25 SECRETARY CHILK:

I have nothing, Mr. Chairman.

4 1

CHAIRMAN ZECH:

The meeting is adjourned.

2 (Whereupon, the commission meeting was adjourned at 3

11:35 o' clock p.m., to reconvene at the Call of the Chair.]
