FEMA hereby responds to Suffolk County's First Request for Production of Documents dated and served on October 10, 1986. All documents not specifically privileged or for which other objection to disclosure is entered are released as follows:

Documents within the possession, custody, or control of the NRC Staff or FEMA and otherwise collected, maintained, or stored in FEMA's central offices at 500 C st., S.W. are being produced at the offices of Kirkpatrick &

While FEMA Counse) is endeavouring to make sure that the most comprehensive search possible is conducted there is certain information FEMA Counsel believes should be brought to the attention of all Counsel in this matter. As indicated in the FEMA GENERAL RESPONSE TO SUFFOLK COUNTY'S FIRST REQUEST FOR PRODUCTION OF DOCUMENTS AND FIRST SET OF INTERROGATORIES TO FEMA dated October 30, 1986, at page 2, paragraph VI. certain individuals are no longer employed by FEMA or the federal government. Additionally, at the request of Senators Daniel P.

Moynihan and Alphonse D'Amato, the General Accounting Office was given complete access to all FEMA files in the central office and the FEMA Region II offices.

No controls were placed on that access and by letter dated

. November 4, 1986, from FEMA Counsel (enclosed with this cover filing) GA0 was asked to inventory and index documents copied or removed. GA0 has now requested that FEMA produce the index and FEMA will do so and furnish to all parties as soon as resources are available.

Documents prior to the June 20,1965, Memorandum from Edward L. Jordan to Richard W. Krimm requesting that FEMA schedule an exercise have not been produced. FEMA objects to the production of documents prior to that date as not being relevant or material to any of the contentions proposed by the Intervenors, and no effort has been made to collect or index such documents.

Although FEMA is producing some documents subsequent to that date that are not otherwise privileged or subject to objection, all parties should be on notice that documents and discussions prior to FEMA agreeing to evaluate the exercise in a letter from Samuel W. Speck to William J.Dircks on October 29, 1985 are objected to in their entirety based on the ruling in Long Island Lighting l

Company (Shoreham Nuclear Power Station, Unit 1), ALAB-773,19 NRC 1333 (1984) l and appropriate affidavits supporting that claim of privilege will be produced if necessary.

II. By responding to this document production request FEMA does not waive it objections (1) to the method of service; (2) to the fact that FEMA is called on to respond for other federal agencies and FEMA or other agencies contractors; (3) that FEMA is not subject to formal discovery under the NRC rules and regulations and the FEMA-NRC Memorandum of Understanding (MOU) dated April 18, 1985; (4) that Counsel to Intervenors has evidenced in writing to Counsel for FEMA that the purposes of its discovery is to obtain information for use other than in this proceeding; (5) that FEMA by responding does not waive any objection based on ALAB-773, supra, and that ALAB-773 is binding on all parties.

FEMA objects to production of any document that may be considered to request information protected by the attorney-client privilege or the attorney work-product doctrine, and this objection includes present Counsel on the record, past Counsel on the record and for George Jett, formerly FEMA General Counsel (1979-1985), Spence Perry, present General Counsel (1985-Present),

George W. Watson, Associate General Counsel, Susan Kantor Bank, Assistant General Counsel, and Lori Jean, Assistant General Counsel, to include comprehensively all their work product presently and in past positions 'related to this matter.

V.

FEMA represents that its response to this First Request for Production of Documents has been prepared without the substantial participation of Roger B.' Kowieski with whom FEMA is currently involved in other legal proceedings.

VI. FEMA recognizes that this request for production is continuing but states that FEMA has produced or will produce by November 19, 1986, all documents not specifically objected to or privileged in accordance with reference to the specific numbered paragraphs of this first request dated October 10, 1986, (note that all documents not produced will be indexed and the index produced) and the FEMA response is set forth below:

FEMA is evaluating furnishing unredacted materials prepared the day,of the exercise, and understands that Counsel to Suffolk County may already have some unredacted materials within this request.

FEMA at this time objects to the release of unredacted materials since to do so would have a chilling-effect on future federal evaluators, simulators, controllers, observers.

FEMA has or will produce all copies of the forms prepared prior to, if any, or during the exercise in redacted form. FEMA does not know if any were prepared subsequent to the exercise, but if they exist they will be produced in redacted form.. The purpose of production in redacted form is to preserve from disclosure specific comments of individual evaluators that might have impact on their future participation or independence in evaluation of exercises of emergency preparedness plans and is protected under ALAB-773.

Coreplete and unredacted copies of all logs generated or maintained by each and every evaluator, controller, simulator, observer, or other FEMA or NRC personnel, during or subsequent to the Exerciss, including all appendicet,

The purpose of redacting is to preserve FEMA claim of privilege under ALAB-773 and until FEMA's Motion to Reconsider is resolved.

FEMA Response:

These documents will not be produced by FEMA, and production is objected to based on the lack of relevancy or admissibility of these documents.

FEMA is willing to offer these to the Board for in, camera inspection to determine admissibility.

' final copies, of all " Exercise Message Forms" generated prior to, during, or subsequent to the Exercise.

FEMA objects to the production of these documents based on relevancy and materiality to the exercise as conducted and evaluated.

FEMA Response:

FEMA has produced this document.

11. All notes, logs, summaries, or other documents, information, or communications concerning the Exercise prepared by FEMA Command post personnel, wherever located, before, during, or afterthe Exercise.

FEMA Response: FEMA wt11 produce all documents in the "before", or "during"' category. Any documents in the "after" category, if they exist, FEMA objects to their release as privileged under ALAB-773.

12. All lists of items to improve the plan and procedures prepared by LERO players or persons, provided prior to, during, or after the Exercise to the federal evaluators, simulators, controllers, or any other FEMA or NRC personnel.

FEMA Response:

FEMA or LILCO has or will produce all documents in this category.

13. Copies of all progress'or other reports, or other information or communications concerning the Exercise made by Bernard Weiss, K. Perkins, C.

Sakenas or any other controller, simulator or evaluator, to the FEMA Senior Controller prior to, during, or after the Exercise and all documents concerning such reports.

FEMA Response:

FEMA will not produce any documents before the exercise.

Documents produced subsequent to the exercise will not be produced based on ALM-773 and pending resolution of FEMA's Motion to Reconsider. Documents not otherwise privileged or objected to produced during the exercise will be produced.

14. Copies of all progress and other reports, or other communications made by the FEMA Senior Controller, or any other controller, evaluator, simulator, observer, or other FEMA or NRC personnel, to the FEMA Region II RAC Chairman prior to, during, or after the Exercise and all documents concerning such reports.

FEMA will produce all documents in this category during the exercise.

The documents produced before and after the exercise are objected to as not relevant or privileged based on ALAB-773 or based on the need to resolve concerns raised by FEMA Motion to Reconsider.

Copies of all progress or other reports, or other communications made by any federal evaluator, controller, simulator, team leader, observer, or other FEMA or NRC personnel, to any other federal evaluator, controller, simulator, team leader, observer, or other FEMA or NRC personnel concerning the Exercise, during or after the Exercise.

FEMA Response: No documents in this category will be produced based on ALAB-773 and the need to have FEMA's Motion for Reconsideration resolved prior to any release.

16. All documents, including notes, comments, or logs, listing, describing, or commenting upon discussions by controllers, evaluators, simulators or observers, with exercise players.

FEMA Response:

FEMA objects to this request based on form since it appears to rgquire comments upon comments. Personnel notes never released to FEMA or any other party but the recorder of the notes are objected to and will not be produced as privileged and protected by ALAB-773.

17. All information, communications, and documents provided to federal evaluators to be used as factual information in developing their evaluations.

. FEMA Response: All documents in this category will be produced.

18. All information and documents describing or concerning any communications, during the Exercise between (a) LILCO controllers, evaluators, observers, or other LILCO personnel or contractors, and (b) federal controllers. evaluators, simulators, observers, or other federal personnel.

FEMA Response: All documents in this category have previously been produced by LILCO, or are being reviewed by FEMA for determinations as to privilege and objections.

19. All information and documents describing or concerning any communications, during the Exercise, between (a) LILCO controllers, evaluators, observers, or other LILCO personnel or contractors, and exercise players.

FEMA Response:

All documents in this category have previously been produced by LILCO.

20. All " summaries" including drafts thereof, prepared by each evaluator on the evening of February 13, 1986, or at any other time summarizing his observations of the Exercise.

FEMA will produce no documents in this category based on privilege and as covered by ALAB-773.

21. All " Exercise Highlights Summaries," and drafts or portions thereof, prepared by each of the team leaders on the evening of February 13, 1986, or at any other time.

To the extent it is not, FEMA objects to the production of any documents in this categcry based on privilege,as asserted in ALAB-773.

FEMA Response:

FEMA will produce the final " Critique" but drafts will not be released and release is objected to based on the claim of privilege asserted in ALAB-773.

24. All drafts of the FEMA Report, and all documents, evaluations, comments. summaries or other information which form the bases for any conclusions, assertions, or facts contained in that report or which were used or referred to in preparing that Report.

On October 10th and October 15th, the Federal Emergency Management Agency was served with extensive interrogatories and document production requests in the Atomic Safety and ;.tcensing Board proceeding on the Shoreham emergency preparedness exercise.

FEMA has answered the interrogatories and made extensive claims'of privilege. We also intend to do so in responding to the request for production of. documents.

It now has been brought to my attention that GAO had complete access to all FEMA files in connection with its ingdiry into certain legal issues :encerning this exercise.

In order to protect the Government?s litigation position, we request the following information:

(1) A c mplete inden and copy of all o&tarials removed from or copies made of FEMA files, and (2) A statement as to the personi who have had access to these materials.

In additic.1, I would appreciate having the opportunity of reviewing in advance any FEMA documents which you contemplate releasing outside of GAO.

I am sure you appreciate my concern that privileged documents are not inadvertently made available to the applicant, LILCO, the intervenors, or their attorneys.

actions, specifically, a

reclassification downgrade and.

a reassignment by reduction-in-force (RIF) regulations.

The appeals have been joined because they contain similar issues, and joinder would expedite case processing without adversely affecting the parties' interests.

For the reasons that follow, the appeal is DISMISSED.

f ANALYSIS AND FINDINGS Effective May 25, 1986, appellant's position of Natural and Technical Hazards Program Manager, GM-14 was reclassified downward to the position of Supervisory Natural and Technical Hazards Program Specialist, GM-13 based on the agency's determination that the position had been erroneously classified.

Appellant received grade and pay retention under 5 U.S.C.

55 5362(a) and 5563(a)

(1982 &

Supp. II 1984).

On June 21, 1986, the agency invoked RIF procedures due to lack of funds and reassigned appellant to the position of Civil Engineer, GS-13.

In his petition, appellant challenges the agency actions.

This case presents jurisdictional issues. The Board's jurisdiction is limited to those areas specifically granted by statute or Office of Personnel Management regulation.

Cowan v. United States, 710 F.2d 803 (Fed. Cir. 1983). In Schaffer v. Merit Systems Protection Board, 751 F.2d 1250 (Fed. Cir. 1985), the United States court of Appeals for the Federal Circuit held that a reclassification downgrade does not constitute an appealable adverse action under 5 U.S.C.

5 7512 (1982 & Supp. II 1984) when an employee receives grade and pay retention. See also Knepp v. Department of the Navy, 709 F.2d 37 (9th Cir.

1983);

Atwell v.

Merit Systems Protection Board, 670 F.2d 272 (D.C. Cir. 1981).

The Board has adopted the Courg's holding.

Department of the Navy, 26 M. S. P. 51.

A reclassification downgrade may constitute an appealable RIF action if the reclassification resulted from a change of duties.

Goodrich v. Department of the Navy, 686 F.2d 169 (3d Cir. 1982).

An employee may appeal a RIF action only if he or she was separated, demoted, or furloughed for more than thirty days by RIF procedures.

In the instant case, appellant has not alleged nor does the record otherwise show that the reclassification downgrade resulted from a change of his job duties.

This is a follow-up to your conversation of Novenber 5,1986, with Ms. Anne Snith of my staff. As I understand it, Mr. Ron 'ernacki, the Food and Drug Administration's B (EA) Region II Radiological Health Representative has been noticed for a deposition in connection with the above-entitled matter. This is to fonnally request that you take whatever steps are necessary to quash the Notice of Deposition which is currently scheduled for November 25, 1986, in Washington, D.C. In this connection, it is the policy of EA that, even in those.. instances where authorized, the deposition should take place at the duty station of the FDA employee, in this case, Brooklyn, New York. Further, the policy of FDA respecting whether the agency's enployees may testify in connection with litigation, hearings, etc. to which E A is not a party is set forth at 21 CFR 20.1. Should you be unable to quash the Notice of Deposition respecting Mr. Bernacki, it will be necessary to obtain my authorization for him to testify pursuant to that regulation.
