CASE AND MEDDIE GREGORY'S REQUEST FOR EXTENSION OF TIME TO RESPOND TO APPLICANTS' AND STAFF'S APPEALS On November 10, 1986, Applicants filed a brief appealing the Licensing Board's Memorandum and Order of October 30, 1986.
On November 13, 1986, Staff filed a. Notice of Appeal of this same order.*
According to the rules, Consolidated Intervenors' responses to these appeals would be due on November 25, 1986, for the Applicants' appeal and on November 28, 1986, for the Staf f's.
Consolidated Intervenors requests that the time for responding to both of these appeals be extended to December 12, 1986, for the following reasons.
This request should not be construed as an admission by Consolidated Intervenors that Staff's appeal was timely filed.

Anthony Z. Roisman is counsel for Meddie Gregory in this proceeding and counsel for CASE in the OL proceeding.
- However, in responding to these appeals, Ms. Juanita Ellis, representative for CASE in this proceeding, will be depending upon Mr. Roisman to represent in his response the interests of CASE as well as those of Meddie Gregory.
He must appear as co-counsel before a Department of Labor Hearing Examiner in Dallas, Texas, on November 18 and 19 in the case of Macktal v. Brown & Root, D.O.L.
Dkt. No. 86-ERA-23 (Mr. Macktal is a former employee of Brown &
Root who alleges he was discharrged in 1986 for reporting safety violations at Comanche Peak).
The following week (November 24),
the secretary who handles all Comanche Peak pleadings at the TLPJ office will be on vacation all week.
In addition, November 28 is the day after Thanksgiving, and the TLPJ office will be closed.
During the week of December 1st, Mr. Roisman will be out of the of fice most of Monday, participating in a prehearing conference in the OL proceeding on Wednesday, and arguing before the United States Court of Appeals for the District of Columbia Circuit in the case of CASE h NRC (C.A. No. 86-1169) on Friday.
All of these previous commitments and holiday constraints make it impossible to answer the appeals of both Staff and Applicants in the time allotted.
Therefore, Consolidated Intervenors request that their time to respond to both appeals be extended to Friday, December 12, 1986.
