MONTHLY STATUS REPORT OF MASSACHUSETTS ATTORNEY GENERAL FRANCIS X. BELLOTTI Attorney General Francis X. Bellotti submits this report in response to the Board's Order of November, 1986.
The Attorney General is unclear exactly what events the Board wishes reported herein, but assumes that the Board is asking a report on the work in which the parties are currently engaged relative to this proceeding that may have an impact on their ability to adequately participate in these hearings.
8-The Attorney General is presently engaged in the following:
1.
The Attorney General has just submitted, on November 12, proposed findings and a brief in support thereof in the onsite portion of this proceeding.
2.
The Attorney General is awaiting a decision on his appeal of the Board decision authorizing issuance of an kDR d h 05000443 861117 ~

l7 operating license to conduct fuel loading and precriticality testing.
Should that decision be adverse to the Attorney General, he may seek a further appeal.
3.
The Attorney General anticipates that the Partial Initial Decision ("PID") on all on-site issues will be issued some time during the month of December, and possibly as early as the first week in December.
Briefs in Support of Appeals of that decision will be due forty days after issuance of the PID.
The Attorney General is therefore now in the process of reviewing the extensive record of this case to determine what, if any, issues already decided he may wish to appeal at that time.

Anticipating that the PID could issue as early as the first week in December, and that such decision may authorize the issuance of a low-power license for Seabrook, the Attorney General is now preparing pleadings to seek an immediate stay of such license issuance.

The Attorney General has been involved, to the extent given the often inadequate notice and other constraints possible, with the Staff and ACRS review of Applicants'
" informal" proposal to reduce to two miles the EPZ around Seabrook.
The Attorney General has submitted expert testimony on this issue to the ACRS, and will continue to stay abreast of the Staff's review of this issue, through participation in meetings, review and analysis of documents, etc. _ _

The Commonwealth will also be participating this month in congressional hearings on Seabrook before the House Subcommittee on Energy Conservation and Power.
7.
In light of the Board's Order of November 4, 1986, the Attorney General is also engaged now reviewing the latest submission of New Hampshire plans.
