Robert A. Backus, Esq.

Backus, Meyer & Solomon 116 Lowell Street fianchester, NH 03105 603-668-7272 On Friday, May 15,1987, at 2:00 p.m., EDT, this Board was served with an " Application for a Subpoena on behalf of the Seacoast Anti-Pollution League." This request was for attendance of David Laughton, Secretary-Treasurer of Teamsters Local No. 633, at the offices of SAPL Counsel at Manchester, NH on Tuesday, May 19, 1987.

bject application did not present a completed appropriate NRC subpoena.

More important, the reouesting party did not (1) make a showinn of general relevance of the testimony sought to any issue admitted by this Board or what may be the nature of the evidence which Counsel seeks; (2) due to the short space of time between request and the designated time for the deposition, there is no opportunity for opposing parties to invoke appropriate quashing procedures; (3) requesting party has not designated a person to serve the witness and there. is no officer or employee of this Commission acquainted with the witness; and (4) Counsel has not made any showing that the witness has been tendered one day's attendance fee and the mileage provided for by law.

For the foregoing reasons, the Application is denied.
