May 15, 1987 STATEMENT MEMORIALIZING TELEPHONE HEARING ON MAY 15, 1987 At the call of the Board a hearing was held by telephone on May 15, 1987 to decide LILCO's motion of May 7,1987 for the acceptance of a protective order or, in the alternative, for expedited referral or certification of the matter to the Appeal Board. Appearances were entered by the parties.

The Board advised the parties that LILC0's actions did not conform to the Board's Order of April 30,1987 (Memorandum and Order (Ruling on County and State Motions to Compel, of April 13,1987)) that required Applicant to furnish the identities of individuals that provided data i

contained in the testimony of witness Charles A. Daverio and to prepare a protective order acceptable to the Board to shield the individuals.

The Board further advised that it did not consider the matter to be properly referable or certifiable to the Appeal Board.

2 We asked LILCO if it were prepared to make the identities known to counsel for Intervenors under a protective order usually utilized before the Commission in similar type circumstances.

LILCO stated that it intended to have the testimony of Mr. Daverio changed in such a way so as to eliminate the involved problem.

LILCO was given until May 19, 1987 to file the proposed change of testimony. Those parties who wish to file a response are to do so by May 26, 1987.
