NOTICE OF VIOLATION Dairyland Power' Cooperative Docket No. 50-409' As a result of the inspection conducted on April 7-9, 1987, and.in accordance with 10 CFR Part 2, Appendix C - Gene'ral Statement of Policy and Procedure for

'NRC Enforcement Actions (1985), the following violation was identified:

'A. Technical Specification 6.8.1.a requires that procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978, be written, established, implemented and maintained. ~ Regulatory Guide 1.33, Revision 2, Appendix A, Section 7.a requires procedures for the liquid radioactive waste system to control radioactivity released to the environment. LACBWRs Operating Manual, Volume I, Integrated Plant Operations Response Procedure for Alarm E14-3, (revised February 1974) for high level in waste water storage tanks, requires in- step 1 under "Immediate Actions," that the operator observe local level indicator at each tank, isolate the " full tank" . . . . .

B. Technical Specification 5.3.1.2 requires that radioactivity content of l each batch of. radioactive liquid waste be determined by sampling and analysis before release.

Contrary to the above, when the high waste water tanks level alarm was received due to high water level in the 3000 GWT while a release was in progress from the 4500 GWT on April 9, 1986, the full tank was not isolated.

Instead, one of the many potential inputs to the 3000 GWT was eliminated by turning off_the Turbine Building sump pumps. As a result of the failure to isolate the 3000 GWT, the tank continued to fill, and overflowed via the overflow pipe to the 4500 GWT while a release was in progress from the i latter tank. This in turn resulted in licensee failure to determine the radioactivity content of this batch of liquid radwaste prior to release (by sampling and analysis) in that the contents of the 3000 GWT tank had not been sampled and analyzed. J Failure to isolate the tanks as required by procedure and the resulting failure to analyze radioactivity content of the combined tank releases e prior to discharge as required by Technic 11 Specification constitutes a Severity Level IV violation (Supplement 1).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation: (1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Consideration may be given to extending your response time for good cause shown.
