Information which discloses patentable subject matter for which it may be desirable to obtain patent protection; g.

Information which General Electric must treat as proprietary according to agreements with other parties.

In our opinion, none of the above definitions of proprietary information are met by the information contained in the WPPSS December 23, 1982 letter.

The letter merely provides a few very general statements regarding (1) the factors that contribute to waterside corrosion of BWR fuel rods, (2) the existence of a material factor contributing to the failure mechanism, (3) the existence of a proprietary test GE has developed to identify susceptible cladding material, l

(4) the fraction of material found to be susceptible to waterside corrosion, (5) the fact that all material processed by GE after a certain date has been subject to the susceptibility test, and (6) that WNP-2 will not use any GE GD rods which have not been subject to the susceptibility test.

Thus, the contributing factors of copper contamination in the reactor water, gadolinia poison rods, and material susceptibility are known to the public-at-large, including GE's i

canpetitors, while the very existence of a test to identify susceptible material (as apart from the details of the tests or the specific metallurgical i

feature that renders the material susceptible) does not meet any of the definitions of proprietariness above.

We believe that the public has a right to know the reason why NRC concludes that corrosion will not be a concern with the WNP-2 fuel.

Inasmuch as it is already known to the public that three factors, viz., fuel duty, reactor water environment, and cladding material contribute to the problem and that no changes are being made to the fuel duty or reactor water chemistry, there-fore, by deduction, the remedy lies in the cladding material.

At least in a general sense, without revealing any specific proprietary details, the public should be informed of the nature of the solution as it applies to WNP-2.

In other words, the right of the public to be apprised out-weighs the concern for protection of an alleged canpetitive position.

It is, there-fore, our intention to reveal the contents of the WPPSS letter in a supple-ment to the WNP-2 SER.

In view of the foregoing, we have concluded that disclosure of the information contained in the above referenced document is in the public interest, that the information is not proprietary, and that it should not, therefore, be withheld i

from public inspection pursuant to 2.790 (b) or 10 CFR Part 2.
